Employment Law BUS 415 University of Phoenix William McKeown March 5, 2006 Employment Law Paper Since John DoeDoe’s administrative assistant left, he has been faced with a hard decision regarding who he will hire for a replacement. Mary Smith is familiar with the company; however this means she is also familiar with the “company gossip.” She is also thought to be a lesbian. The second candidate, John Jones has many years of experience in the administrative field and is requesting three thousand dollars per year less than Mary. However, Mr. Jones is in a wheelchair. Mr. DoeDoe must make a decision on a new administrative assistant, but the two candidates available leave many opportunities for someone to cry “discrimination.” Discussed here will be the possible discrimination issues for both candidates, and how the different cultures may play a role in these issues.…show more content…
If Mr. DoeDoe chooses not to hire Mary, one of the first issues to be questioned is; was she not hired because she is female? Title VII of the civil Rights Act of 1964 states that an employer cannot base their decision to hire or not hire a person based on their race, color, religion, sex or national origin (Cheeseman, pg 802). Since Mary is a female up against a male for higher position than she currently holds, she can claim that Mr. DoeDoe did not promote her because she is a woman.
