Also people that are in corrections are there to maintain justice. These three components of the criminal justice system work together to create punishment for individuals that are proven guilty and help to stop them from committing other crimes, all while maintaining fairness, and keeping the rest of society safe. The basic rights of citizens are affected by criminal law by preventing citizens from doing any and everything they want to do. As citizens of the United States, we already have basic rights that we are awarded with by being born an American citizen. Basic rights are protected by criminal law.
This theory also includes factors such as mental illness and childhood abuse. Another theory is situational theory; which focuses on specific events that may contribute to criminality such as being labelled ‘delinquent’ or a ‘menace to society’, lack of parental supervision and the peer groups and social networks can contribute to criminality. The third theory is social structural; this theory covers factors such as, unemployment, racism and poverty. All of these factors can contribute to a person partaking in criminal behaviour. With all of these theories taken into consideration it is easy to see that crime is inevitable and a criminal justice system is needed in order to protect people in society.
Discuss the powers of police in the criminal process. Make reference to the role of discretion in the criminal justice system Police powers, refers to the authority that the law enforcement body has when investigating a crime. The powers that police have include search and seizure, access to information, interrogation, electronic surveillance, medical examinations, detention, fingerprints and photographing. These powers allow police to deepen their investigation and to effectively obtain justice for victims and society. Furthermore, the discretion of police can play a large role in the investigation of criminal offences; however, it can lead to certain individuals in society being targeted.
Other questions that I will also talk about are how to reduce ethical problems in an investigation, what prosecution problems could arise and what ethical issues are related to the prosecution. What are the specific ethical considerations that need to be addressed when investigating the specific crime? When an investigator is investigating a rape, he or she would need to be very sympathetic and try to understand that the victim is going through a horrific incident. The investigator must be very careful when asking the victim questions about the rape and the suspect/suspects and not to assume anything. This information could be used as evidence later when it goes to trial in court.
The police are there to help by phone, internet or in person. They are there to solve crimes, help the public, and maintain safety and security. The police also have to help individuals within, for example if a person is fearful for their safety, then the police would investigate the matter and reassure them, or if a person has gone missing then the police would do anything in their power to find the missing person. The police are a statutory service because it entitles them in their duties to maintain the safety of the public; they also help to form better communities. The police are required to protect and serve in any dangerous situations and as much as possible.

Week 1: Aims of the criminal Justice system This week was essentially an introductory topic and provided me with a basic understanding of the aims and operations of the criminal justice system. I learned that there is a number of different steps within the criminal justice system and the involvement of all the parties involved such as police, judge and jury and the defence. According to John Champion the main purpose of the criminal justice system is to process and prosecute individuals who commit crimes against society and to deal out suitable punishments for these individuals. This is a pivotal part in terms of maintain the functioning of society and to ensure that people don’t go around breaking laws wherever and whenever they want.
Keeping the peace means providing a presence at known trouble hot spots for example city centres. A police officer will also investigate allegations of any offence that is put before them. They will use good operational knowledge to decipher if the allegations are genuine and if so, they will report the crime and have it investigated. The police also provide high visibility policing to major events like football matches etc in order to prevent incidents of any criminality. Many police services also set local priorities which largely depend on the needs of their particular area for example, the police service in rural may have a very different set of problems from police services in urban areas.

The chain of custody, if done properly, is proof to the court that the evidence in front of them is the same evidence that was collected at the crime scene. “The tagging, labeling and marking of the evidence adds credibility and control to our ability to identifying the item. “ (Byrd) The policy will affect everyone involved in the case. If the chain of custody is broken the suspect may get away with the crime because the evidence had to be thrown out. It would give the law enforcement personnel a bad name or rap because he or she broke the policy.
