Valea Rosenfield Careers in Criminal Justice Week 11- Individual Work Due Date: 3/31/2014 I am very interested in working as a victim advocate for victims of sexual assault. Well, the defense attorney is supposed to protect the defendant's rights prior to trial. In a civil case, the defense attorney will file papers responding to the plaintiff's case, will investigate the case, talk to the defendant, talk to witnesses, gather evidence, get ready for trial, and negotiate with the plaintiff. In a criminal case, the defense attorney's role is even more strongly aligned with the defendant, to do everything they can to try to prevent the defendant from being found guilty; whether that's by going to trial or negotiating a plea bargain. Most criminal cases end with the defense agreeing to plead guilty to something. It's the defense attorney's role to try to get the charges reduced as much as possible.
When discussing research methods in the criminal-justice system, a vital role has to be acted out by the researcher. Researchers should know that without the ability to conduct effective research, there would be problems in some areas of the justice system. Another area of research is the terminology that is used among law enforcement, doctors, etc. Terminology is important when being used during any type of study within the criminal-justice system. This paper will cover some of the terminology researchers may use on a daily basis and what methods could be applied to the Criminal Justice System.
The job of law enforcement personnel can be dangerous depending on the position you hold, it’s important that there are guidelines in the different aspects of working conditions or hazards you may encounter. As I move forward with my education I want to make sure I keep safety in mind when I choose my career. If I end up working in an office setting and not in the field, I will encounter fewer hazards. If I go into forensic psychology I am told I could be dealing directly with criminals, going into correctional facilities to interview criminals so extra precaution should be taken to make sure I am protecting myself and I am aware of my surroundings. If I end up being a criminalist, I would be using chemicals that could be dangerous so knowing how to avoid the possible hazard is important.
Both of these functions are important for the protection of the public safety and the operation of the system. Adjudication is one primary focuses of the courts today. This means that the courts have to decide who is going to have to answer for a criminal act. If there wasn’t adjudication, prosecutors would be filing charges in vain. Courts play an important part in determine who is and isn’t guilty.
Instead of staying in a darkened room, the commanders should be training their officers on how to combat this action and help actual reduce the crimes not cover them up. They need to make sure that officers know the importance of CompStat and how it benefits their department. CompStat can be a great tool, but it must be implemented and used correctly and information cannot be falsified to give data that is wanted. If the information is correct than it can help us ensure that our police department are working to actually reduce crime not just to make their department look good. This information can be used for many different reasons and if individuals knew that police departments were doing everything in their power to actually reduce crimes some areas would not be so scary to live in or
Due Process Abstract This paper will discuss the concept of Due Process and how it affects the criminal justice system. In addition, the reader will also gain knowledge of how the adversarial system works. Also the rights of the accused and the process after a crime has been committed through post-arrest procedures will also be discussed in detail. Due process is envisioned to provide citizens of the United States with protection from government infringement on legal rights to life, liberty, and property without due process of law. The government cannot deny a defendant convicted of a capital crime of his or her life before the appeals process has been depleted.
The lead profiler on any case can be someone from within or outside the department depending on the skill levels available internally and preferably, a teamwork approach to case analysis would create a continuing dialogue that would not entirely hinge on the opinion of one investigator or profiler. While it is desirable to narrow the suspect list down to a workable size for the investigators, it is also necessary to prevent personal whims from causing tunnel vision and causing the exclusion of viable suspects. The four basic skills necessary for good Investigative Criminal Profiling - investigations, forensics, psychological assessment and the application of cultural anthropology - are necessary to a complete an accurate profile. It should be recognized that experts should be consulted to fill in the gaps. A homicide investigator with limited skills in profiling might combine his skills with that of a professional profiler and as a team, increase the success of the
This criminal law website is determined to keep people who are under investigation or have already been arrested, to keep their record clean and out of jail. Criminal Procedure Criminal procedures are debatable on what is more effective and how to implement such policies. Due Process and Crime Control are two different models that explain the criminal procedure policy of the United States, and they will be discussed in this paper. Along with how the Fourth, Fifth, Sixth, and Fourteenth Amendments impact both of these models. The final subject of this paper will be how the Fourteenth Amendment applied the Bill of Rights to the states. The Due Process Model is a process that works on the assumption that the criminal justice system has errors, and because of those errors a defendant is not guilty until proven otherwise.
