Role and Functions of Law Law/421 July 8, 2013 Introduction In the case of “Cipollone v. Liggett Group, Inc.,” there was a lawsuit filed against Liggett Group for the violation of New Jersey’s consumer protection statues alleging Liggett was responsible for the demise of his mother, and engaged in the course of false advertisement, misrepresenting the hazards of smoking, and acting devious in not informing the public of scientific and medical information. There was some urgency by Liggett for the court “to dismiss the state law claims contending that the claims related to the manufacture’s advertising and promotional activities were preempted by two federal laws: (1) the Federal Cigarette Labeling and Advertising Act of 1965, and (2) the Public Health Cigarette Smoking Act of 1969.” (2011, Melvin). Role of Law The law has a crucial role in society by helping provide protection of individuals, and obtain social control. The reality of it is most people do not want to be a part of something damaging to them, and for inconsequential reason this could be essential at times. The laws are made to appear simple; however here in the United States the laws are complex. “Article VI of the Constitution provides that the laws of the United States shall be the supreme Law of the Land.” (2011, Melvin). Laws are put in place for a reason, such as solving disputes, these are acts of rules to be followed, this allows order among society, and makes people aware of what is acceptable and not acceptable. People who choose to not obey laws will be removed from society by court order. Society will feel more at ease within their community. The demise of society would happen so quickly without role of law. “Law of the Land” is the way it should be, those who do not follow these laws will be band from society.
