When such cases are reported many people come to know about it and the victim is looked down upon. 5. Why are issues of harassment and bullying so difficult to resolve? (3 marks) Because freedom of speech issues clouds the distinction between harassment and comment. A lot of the time people are scared to give the bully away because the bully has threatened them, also it is also hard to detect a bully when the bullying is cyber because nobody has seen the bully do it face to
From a legal standpoint this makes Battered Woman Syndrome a difficult defense to use. Despite the difficulties of proving a battered woman case I believe that Battered Woman Syndrome should be used as a viable defense. Battered Woman Syndrome is used a defense in many jurisdictions in which the victim of abuse eventually hits a breaking point and kills the abuser. This defense is usually only allowed in cases where the woman believes that her abuser will kill her if she does not kill him first. Using this defense poses many difficulties.
Sometimes it could get so intense that the attorney may abstain from probing further. This is usually very trying for the attorney who finds herself at the cross roads: wanting to get the entire truth in order to prepare a good case and not wanting to push too hard out of sympathy for the obviously distraught victim. Similarly, asking tough personal questions is also very exigent especially when it has to do with sexual violence and this demands a lot of tact from the attorney/case handler. Situations such as these usually cause valued information to be left out. Despite these barriers and challenges, VAWA self-petition continues to be a very vital tool in combating domestic violence especially for immigrant victims of domestic violence in the United States.
The citizens feel they are guilty until proven innocent. There can be uprising in communities where these actions are taking place causing more instability in high crime areas. When a suspect is arrested, they are more likely to resist arrest due to the perception that they may be abused while in custody. The law enforcement code and the cop code are tied to public perceptions on the role of law enforcement because the citizens believe the complete force is corrupt due to the actions of a few officers. The actions of just a few officers are put on the news for viewers to see.
Victims of Stalking/Criminal Harassment Jessica Beaulieu/995908 Victimology Brenda Thomas Stalking has recently emerged as a social problem, becoming more clinically researched and being made more aware to the public as a problem. It has come to the attention of many jurisdictions and is now a criminal offence. The word “stalk” was basically defined as the act of following ones prey or walking stealthily (Mullen, Pathe, & Purcell, 2000). There was once no legal definition for stalking, people described it as being pestered or frequently followed by strangers; looking back on their experiences, now that there is a definition they realize they were stalked. Stalking has become more dangerous, victimization is becoming worse to the extent that they are murdered often times.
Memo for Boss To: Mr. Angel Law Firm Boss From: Attorney Clapper Date: May 4, 2014 Re: Memo addressing concerns of the client Dear Mr. Angel, I would like to address some of the concerns for our current client in hopes that this will help ease her worries. I understand that she is the current victim of a sexual assault but she did not report what had happened to the police. It is my understanding that she would like to sue the person and possibly have him put in jail on charges for the crime. I do feel that the client does need to know her rights and deserves to have justice. I have conducted some research for her that I am in hopes she will find informational and helpful to her.
We know that police officers use excessive force, and they also use their authority to verbally abuse people. So what causes police officers to abuse their authority, and (or) leads to brutality? One of the challenges with this is that not every citizen reports a police brutality, whether they see one happening, heard of one happening from their friends or family or if they themselves were a victim of one. Another challenging issue too is that we know some brutalities are not reported; therefore it makes it harder to measure those versus what is actually reported. Police brutality wouldn’t be an issue if we didn’t have to police our law enforcement officers.
In her editorial “Restraining orders hurt women,” author Carey Roberts claims, “Restraining orders are not only ineffective, they can also escalate partner conflict.” But how can she support her claim that they are ineffective? Roberts is not looking at the whole story. Although there may be a small number of cases in which her opinion is true, it is impossible to know the number of cases in which restraining orders help those victims who need them. There may be vast numbers of people who have been deterred from physical or mental abuse because they did have fear of the law’s repercussions if they were to violate a restraining order that was taken out against them. There will always be a small number of people who will, regardless of penalty,
Hannah Mr. Elenbaas Advanced Composition 8 January 2014 Should Minors be Tried as Adults? There is much controversy over the issue of whether a child should be tried as an adult if convicted of a violent crime. Minors are starting to watch adults who are doing violent crimes, and they think it might be okay if they do it too. But does this mean we can punish minors like adults? Minors should not be tried as adults because they have not experienced the world like adults have, and they are not competent enough to go through or understand a trial.
The guest speakers taught us of many forms of abuse. I rather not talk of my past but I can be certain that sometimes if you are in an abusive relationship you fail to realize so many signs and signals or just put yourself in a state of denial. So questions I have come up with to help others realize when they are in are: Does he "just" slap you? Has he beaten you up "only" 3 or 4 times?
