Attitude, Legislation, and Litigation Abstract Over the years opinions have changed in regards to students with disabilities, which have lead to amendments to legislation and litigation in association with the public school systems. These amendments have led to inclusion in the classroom, and also created a challenge for teachers to accommodate for individual student needs, they also set the bar higher for the future administrations in the legislation and accommodative progress within the schools. We interviewed Carolyn and her parents about her older brother, Jimmy’s exceptionality. Carolyn explained the struggles and life lessons learned over their time growing up together, and expresses her wishes that special education continue to improve to insure that students with disabilities receive the maximum amount of aide offered. Attitude, Legislation, and Litigation The education of students with disabilities has changed drastically over the years. Twenty years ago, classrooms were nearly devoid of exceptional students; and if any were to be enrolled in the school, they were sent in a class merely to be looked after. However, in today’s classroom, students with disabilities are highly valued and recognized by legislation as individuals worthy of fair instruction, where they can be acquainted with society and taught how to function successfully on their own. Teachers country-wide are expected to do everything thing in their power to fill the needs of each individual student in their classroom. Schools have implemented IEPs and RtIs to assure parents that their children are receiving adequate attention in their schooling. On a county and state lever, school boards are assigning, trained individuals to oversee and assist general educators in improving their methods of reconstructing their curriculum, on a nation-wide level, the
