Employees can become a source of risk because acts such as injuries in the workplace can cost the company money in medical expenses and potential lawsuits. Employees can file a lawsuit against the employer for a variety of reasons including wrongful termination of employment, sexual harassment, and discrimination among other reasons. He does not believe that in order for business management to succeed that they must include unethical or illegal methods to be able to succeed. Solomon believes that business management is not as simple as making revenue. He acknowledges that while illegal and unethical practices in business management could bring positive results in the short run, eventually the business is going to fail in the long run. A person may be part of a protected class but not qualified for the job so the employer cannot reasonably consider that person for the position. A person may have applied for a position that the employer was not actively seeking to fill, or the person may not belong to a protected class at all. However, when all four factors are present, there is quite a lot of evidence to prove the case of discrimination. Once an employee or job applicant files a charge enforcement proceedings begin. The main issue is to prove, by either direct or circumstantial evidence, if the employer’s actions were motivated by discriminatory intent.
With all of the different working conditions, wages, races, and experience that we saw is Hollitz chapter 2, we can make a generalization that the worker’s level of distress was high. There are three questions that come to mind. First, overall do the working conditions appear to be improving or getting worse? Second, What do workers think about their conditions? Third, would you agree to what William Sumner said that it was not the role of the government to improve the conditions of the working classes, the claim of some writers that employers treated workers as a mere commodity, Sumner also asserted, was “ludicrous” in the “cold light of reason?” After some reading all the sources I can say that conditions got worse then were fixed later, some workers did not like their jobs, and I do not agree with Sumner’s argument.
Also Newton refers to discrimination as an act of injustice towards the receiver. For example, if a woman is turned down for a job because a male with the same qualifications was also interviewed and received the position due to his gender. Newton doesn’t agree with this injustice but also wonders since more people are realizing that not choosing persons due to their gender or race is discrimination, if they are giving women and or African Americans special treatment so that their company can look diverse and nondiscriminatory. If true, then the rest of workers are now having the bulk of injustice done to them. Newton states, “It is, then, an ironic paradox” (414).
