Unit 304 2.1 While working in care, the aim is to give the best possible standard of care to service users, but sometimes there can be a conflict beetween the individual’s or their family’s wishes and rights and the duty of care. In this case the most important thing is to decide whether the person is aware of the risks and consequences of the decision and has the capacity to make the decision. Before taking best interest decisions I have to make sure that the person definitely lacks the capacity. The person or their next of kin has an overall right and responsibility in decision making for issues relating their care, and I need their consent to deal with certain issues. When a dilemma arises, my responsibility is to support individuals or their families to make informed choices.

All information should remain confidential, and if the therapist breaches this, then they are likely to be sued. However if the life of the person is at risk or society as a whole then we may deem it necessary to breach confidentiality, however there is no consensus on what is deemed as harmful, and we would need to follow our governing body such as the BACP or Hypnotherapy society guidelines on how to deal with this. In most cases if you feel confidentiality has to be breached you should inform your client, as to the reasons why, this should be discussed in the initial consultation how and when you would do this, so you have an agreement before you start
Describe the potential tension between maintaining an individual’s confidentiality and disclosing concerns There are some situations when confidentiality needs to be breached to report information to a higher authority. The disclosure of private and personal information should only take place when: ▶ withholding the information is likely to threaten the safety and wellbeing of others ▶ a crime has been, or is likely to be committed. It is my responsibility to check the policy and procedure at my place of work about disclosure of confidential information, in order to be clear about how to act and who to contact should the need arise. This is mainly because the incorporation of the client places limits on the direction of the sessions in the group. Another issue is that is unique to group counseling is confidentiality.
