PROCUREMENT CONTRACT MANAGEMENT IN PUBLIC SECTOR – TANZANIAN EXPERIENCE By Engineer Ramadhan S. Mlinga Bsc. Engineering (Civil), Msc. (Construction Management), PhD. Chief Executive Officer, Public Procurement Regulatory Authority. 1.0 INTRODUCTION Contract administration is an important aspect in the procurement cycle which ensures that the Client gets what he procured. Unfortunately, it is a stage which is not given adequate attention during contract implementation thus causing unnecessary complaints of the parties to a contract. Clients puts in a lot of efforts in the procurement process to ensure that they select a contractor, supplier or service providers who shall deliver the works, goods, services of the required quality, in a timely manner and within the agreed costs. The selection process is however, in some cases, not supported by a vigorous system which ensure that what was bought is indeed what is delivered. This paper looks at the public procurement regime in Tanzania and how it offers the Client and the Contractor the assurance of getting what they contracted for . 2.0 2.1 GENERAL ASPECTS OF CONTRACT ADMINISTRATION Importance of Proper Contract Management Contract administration or management 1 involves those activities performed by procuring entity (PE) after a contract has been awarded to determine how well the PE and the contractor 2 performed to meet the requirements of the contract. It encompasses all dealings between the PE and the contractor from the time the contract is awarded until the work has been completed and accepted or the contract terminated, payment has been made, and disputes have been resolved. As such, contract administration constitutes that primary part of the procurement process that assures the PE gets what it paid for.
