Police discretion is the power or authority that is given to a police officer to act officially in a manner that appears to be just and proper under the presented circumstances. In a domestic disturbance, the police officer has to use his discretion based upon the situation before him. The officer needs to make a decision that will make both parties involved be content with the resolution. This discretion that a police officer uses at the time of a domestic disturbance is the most difficult because his decisions ends up affecting either parties to a situation for the better or for the worse. In such situation, the officer can either mediate a peaceful agreement, can suggest counseling or if this doesn’t work he can also make an arrest of the person that is not willing to come to a peaceful resolution to the problem.
Police brutality wouldn’t be an issue if we didn’t have to police our law enforcement officers. Policing our law enforcement officers is a challenge in itself, because who is responsible for this job, how are they going to police them, what actions are they going to take against them when they catch them and what are the penalties for
The fact that officers know that illegally obtained (but true) evidence will quite possibly be thrown out, and therefore dangerous criminals will be freed, will encourage them to follow the proper procedures. (Woodfin, 2009) In addition, there are already several exceptions to requiring a warrant, such as “stop-and-frisk”, airport and school searches, voluntary searches, and emergency situations (Scheb, 2008) While these arguments supported the continued use of the exclusionary rule, there are also many argue against its value to our criminal justice system. One of the most
This paper while not cover the ethics behind lethal force, but will discuss the steps, and progressions leading up to that point. Non-lethal force is very common for a police officer to use in their career. A law enforcement agency must carefully choose the various devices, and techniques it will authorize for the protection of its officers and the public. In making policy decisions in this area, an agency should consider existing court decisions and litigation trends. Use of force is a very important part of an officer’s ability to keep themselves and the public safe, but is also very controversial.
The purpose also is if law enforcement was to take the evidence it would not be used in the court of law unless issue or that person can be set free of all charges. Basically one wrong moved can make us lose a suspect of a horrible crime if we are not careful. Law enforcement just need to be cautious so they are doing their jobs correct, and setting a person free will get them into trouble (cjlf.org, 2011). When we are identifying the exclusionary rule it is a great rule to have so police have to stop and think. Police have to think before they search because it could cost them a lot if they just do what they want.
Secondly, this group shares a common way of life. They share similar dangers, setbacks, and rewards that outsiders rarely see outside of the movies. Thirdly, these dangers foster an "us against them" mentality not just against criminals but politicians, bureaucrats and concerned citizens who are perceived as impediments to enforcing the law. Police administrators and the law specify the broad parameters within which officers operate, but the police subculture tells them how to go about their tasks, how hard to work, what kinds of relationships to have with their fellow officers and other categories of people with whom they interact, and how they should feel about police administrators, judges, laws, and the requirements and restrictions they impose. The effects of formal pressures and the pressures generated by the police subculture often lead police officers to experience a great deal of stress in their occupational, social, and family lives which can result in cynicism, burnout, and retirement, as well as other of physical and emotional ailments (Miller 45).
If someone has been in a lot of trouble with the law, they probably aren’t going to have very many good things to say about police officers. Where as if somebody is related to or close to a police officer, they might have a better perception. Police-community relations are very important for the police and for the community. The community needs to be able to trust the police and vice-versa. If an individual has a bad experience with a cop, they are going to tell everybody they know and therefore those people might form negative perceptions based off of that.
Reactive patrol is when police organizations around the world respond to a situation which is either called in or brought to their attention. This type of patrol can be the result of a request of 911 emergency calls or perhaps a citizen flagging them down. Reactive patrol does have benefits to help fighting crime yet at times if a proactive stance was taken maybe a reactive patrol would not be in order. Proactive patrol is when a police organization will assign an officer to patrol a certain area in order to deter criminal activity from happening. Proactive patrol has been known to deter crime in areas where criminal activity is high.
Concept of Police Personality Paper Charles Reedy Jr. CJA/333 November 14, 2011 Daniel Jones The personality of a police officer can be no different from a person that’s not an officer. The difference will be how a police officer applies his or her personality towards the job. A police officer is faced with many different challenges on the daily basis, and how he or she conducts her or himself on and off the job, and this will determine if that officer is truly dedicated and knowledgeable about their job. The personality of the officer is always a key factor on the outcome of the situations that may arise. Concept of Police Personality Paper Police officers are faced with life and death situations on the daily basis, and at times this can alter the personality of that individual.
One thing that is important to remember is the use of terminology within your career path whether it be in criminal justice or not. The last thing any of us would ever want to endure is dealing with someone whom isn’t fully knowledgeable on a subject matter when we need them to be that is. I think one thing that I realized about the researching process is that it’s not always the same for everyone and what my methods are may differ entirely from what another’s might be. Nonetheless having an organized plan of attack in gathering the information you require is what the common goal should be for us all, and however you obtain that is all that really counts in the end. I hope my paper has helped you understand what methods I choose to address when I conduct my own researches and/or papers.
