I have to act in the person’s best interest but instead of encouraging them to avoid risks I have to support them and enable them to taking part in activities. I have to act in the individuals best interest, keep them safe, carry out risk assessments, promote informed choices but also respect their decision and right to live their life as they choose. If the risk seems great to me I would document it and discuss the matter with my manager. Another area where duty of care dilemmas may arise are confidentiality issues. When a confidential information is shared with me and it concerns safeguarding and there is a possibility of harm or someone’s wellbeing is threathened I might have to make a decision and disclose this information.
My employer must follow the Management of Health and Safety at Work Regulations 1992, their responsibilities are to provide the mandatory training and supervisions, ensure policies and procedures are put in place, plan, organise, control, monitor and review health and safety arrangements, make sure the equipment is available and to maintain risk assessments and to deal with chemicals and other substances safely. As an employee I also have to follow COSHH 2002 (control of substances hazardous to health) in my workplace. This means I have to follow the procedures set in place by my employer and attend training. I have to make sure any hazardous substances are kept locked away where unauthorized people cannot get them. I also need to dispose of hazardous substances correctly and not mix substances in case of any hazardous fumes or explosions that may occur.

Moving and Handling Moving and handling is the core part of the day for most employees in the social care setting, legislation, policies and procedures that relate to moving and handling help to keep us safe. Legislation Manual Handling Regulations 1992 These regulations define that employers are required to avoid the need for manual handling so far as is reasonably practicable, assess the risk of injury from manual handling and reduce these risks. The employees have a duty to follow instructions, systems and use equipment that relate to safe manual handling. Provision and Use of Work Equipment Regulations (PUWER) 1998 These regulations require that equipment is suitable and safe for its intended use with regular inspections and maintenance. Only used by persons that have received adequate information, instruction and training.
Regularly do risk assessments so that they can minimise and identify any potential risk that could hard staff or service users. To make sure that I am safe at all times and I don’t put others at risk due to my actions. Make sure that we only do things that we are trained to do and the way that we have been trained to do so. Keep our training all up to date and make sure that we make note of any changes passed on by our manager. Assignment 307 Task B Guidelines Best practice in handling information Staff must follow the data protection act and keep patient’s records up to date, accurate and legible. To do this staff must :- Write information about individual patient’s in their records at the end of every working shift. Written information about patient’s must be factual and accurate. Do not make assumptions or opinions about the patient. Information that is written in records must have a date, time of entry and the name who has written the information.

In my setting I have a duty of care (a requirement to exercise a reasonable degree of attention and caution to avoid negligence which would lead to harm to other people) to provide a safe environment and ensure that I am vigilant and pay attention to make sure I keep all young children safe as they develop.
