Partner From: Sr. Paralegal Re: John Stockely October 08, 2012 Case: John Stockely v. AAA Auto Dealers Issue: Whether AAA Auto Dealers is vicariously liable for John’s negligence. Facts: John Stockely worked as a sales executive for AAA Auto Dealers. He was given a company car to drive to a manufacturing facility, which is 150 miles from the dealership, to check on new orders. John Stockely was also reimbursed for gas, food and lodging. The evening of the car accident in question John’s boss accompanied him on this trip. John decided to stop off at his cousin house for dinner. John’s boss was in agreement with stopping off for dinner. In route to John’s cousin house he collided with and injured a motorcyclist. Rule: John Stockely accident is clearly in the scope of employment. Respondeat Superior. 4) What search method did you use (Terms & Connectors, Natural Language, and/or Easy Search)? A) In Black's Law Dictionary I used easy search and what I need it pulled right up and then gave me links to different cases was very easy.
