Synopsis of Tort Cases Team D Members: University of Phoenix BUS/415 MU10BSB08 Aug 8, 2011 Synopsis of Tort Cases This paper will discuss the four case studies presented in week three of the syllabus. The members of team D reviewed each case study for tort liability actions: intentional or unintentional. Additionally, potential defendants and their potential for defense are discussed. Lastly, the elements that constitute the plaintiffs case are explained, and supported by legal reasoning. Scenario One This scenario has several incidents of tort liabilities. Some of the incidents are punishable under the laws that govern tort liabilities and others that will not apply. In scenario one, a fan; Ruben, was injured during a football game. The game ball landed on him after a drop pass from one of the teams on the field. According to a sports article, in this case, the injured fan would not be able to win a lawsuit because of the assumption of risk that he understood when he walked into the park. Assumption of risk protects a business liability; in this case the football stadium owners. Each fan that goes into the stadium knows that something may go wrong therefore, they assume the risk by purchasing the ticket and participating as a spectator. After Ruben was hit with the football, Malik’ accidently spilt his beer on Ruben. Rubens father Daniel became upset with the chain of events and push Malik’. Daniel’s upset reaction resulted in him shoving Malik and knocking two of his teeth out of his mouth. This act is called intentional tort battery. Malik would be the plaintiff in this case and Daniel will be the defendant. In this case, the claim will probably be resolved with Daniel paying a fine, and jail time.
