Labor Laws & Unions As people look at the workforce, some do not realize that it is not only divided by companies and positions but also by union and non-union. Being a part of a union can provide many benefits to its participants; however, they can also encounter many legality issues. To closer examine the things involved within a union, an exploration of the NFL Players Association (NFLPA) will be used. The author will provide a background on the NFLPA, some legal issues they may encounter because of different laws in place, and some possible recommendations to minimize litigation. The NFLPA has come up against several legal issues over the years, including contractual issues, antitrust laws, and most notable inherent risk issues. Most of the time the NFLPA can go up against the contractual issues brought forth and help a player come to an agreed end. The NFLPA would have to be dissolved for a player to go up on the antitrust laws, though, due to a collective bargaining clause, which is present when a union is involved (Feldman, 2011). Last, inherent risk issues are being brought forth due to concussions the players have had during play, and at this point although many lawsuits are pending. The NFLPA exists not only as a voice for the players, but also as an entity to withstand legal backlash as a combined force. They do not want the players’ contracts to be violated nor do they want their members to be involved in illegal acts; however, they want to try and limit legal actions brought against them. This is a reason they are still trying to stay out of the biggest litigation brought on to the NFL ever. Although they probably will not avoid being dragged into the middle of it, they should at least begin evaluating their stance and how to approach the newest legal
