The youths that are being tried in the adult courts should be offered to better themselves as for they are not fully developed at the ages under eighteen. Punishing a teen by taking away their rights for life is not helping the betterment of society. Another person in prison means more local taxes for another set of clothing, more food, and occasionally, more space to be built. A psychologist could benefit from these children who caused trouble, especially if the trouble was un intentional. Juveniles have greater possibility than adults to make a change in their lives with the right help with counseling and rehabilitation.
When the prisoner is released, they may be very angry about the lack of attention they recieved, and become a repeat offender. Rehab gives one a chance to learn about his/her debilitating problems and offers to help them change. It also helps to ease the offender’s reentry into society. The Juvenile Justice System has the bases of the Adult Justice System but the goals are much different. In the juvenile courts a child’s privacy is protected from the public. They focus on the needs of the child, trying to identify problems they are having and find solutions, treatments and support systems, to help them to stay out of the court system rather than punishment. Juvenile systems also believe that there shouldn’t be any long term confinement and that no matter what offense that you committed as a child you should be released by the age of twenty-one. The court process for the juvenile can last from a couple hours to a couple days long and are informal in nature without a jury.
Elizabeth stated that when a juvenile is put on probation the probation officer works with the parents to try and steer the juvenile straight. What this means is that it is the probation officer and parent’s responsibility to try and help the juvenile put and end to his/her recidivism. The only negative about the probation officer and the parents working together is the parent’s inability to help the juvenile or the probation officer. I forgot to ask Elizabeth how often do juveniles become rehabilitated especially when the parents and probation officer work together. If the juvenile’s parents are avid about steering their son or daughter’s ways then this is an effective method, but as we know that’s not always the case.
Educational programs can help to help children obtain a good education make sure every child is doing well. “Increase existing programs to keep children succeeding in school, and out of the criminal justice system hold the most promise to reduce incarceration rates” (North Carolina Criminal Justice Analysis Center). Lack of education can cause individuals to turn to and remain in a life of crime. “National surveys indicate that 70% of inmates entering state prisons have not graduated from high school and 40% are functionally illiterate” (Young). Making the effort to ensure that a higher level of education is attainable for all citizens would be considered a step in the right direction towards educating youth.
Gianna Bianca 04/04/2013 Protecting the Children with Jessica’s Law Every two minutes in the United States, someone is sexually abused. 44% of these victims are under the age of 18 years old (CDC). These statistics are bold, but even worse – these crimes can be prevented. Crimes against children that involve sexual abuse can be prevented in one giant way: by keeping the predators in prison there they belong. This seems like a no brainer, however some judges and members of senate disagree that these illicit crimes are punishable by lengthy sentences and strict court conditions.
There has been many a time in my life, as I’m sure there has been in everyone else’s, that being given the second chance has made the difference. But I do believe, however trite this may sound, that if you do an adult crime, you do adult time. Minors that commit certain serious crimes should be tried as adults. Some youths are even known to commit crimes without thought because they know they cannot be tried as adults. Violent, preventable crimes by minors have long plagued America’s larger cities but have scarcely been punished because of the age of the perpetrators.
Which comes in, why kids shouldn’t be try as an adult. Most of us teens act pretty much like kids when were still 15-17 years old. In Adam Liptak’s article “Supreme Court to Rule on Executing Young Killers” published in The New York Times quotes “And jurors may not necessarily accept expert testimony concerning recent research showing that the adolescent brain is not fully developed”. Jurors have to accept the fact that teens brains aren’t develop and still may act like little kids. Also the fact that teens are so rough towards one another there brains aren’t thinking on what can happen if there physical towards people violently.
The first thing that I would change would be to enforce harsher punishment for crimes so as to defer young teens from making the same mistakes again. Now-a-days a young person can commit a crime, and get a small punishment from the juvenile system and be out the next day. They eventually learn that if they keep committing these crimes, then they will keep being able to get away with it with only a small punishment. Kids these days are not stupid, they will eventually catch on to the fact that they are not being punished nearly as harsh as they should be and that alone will tell them that they should just keep doing it. If they are negative for drugs then they should still receive welfare, while still being watched and on probation for another year. On the other hand, if they are tested positive for drugs in the following year I believe they should be arrested. It’s already against the law to do drugs so it is not like we are treating them differently than any other American. Those going to jail actually may be a better lifestyle for some of them.
