[1] Know the statutory responsibilities and rights or employees and employers within own area of work [1.1] All aspects of employment are covered by law, examples include: • Minimum wage• Hours of work• Health and safety• Annual leave entitlements• Redundancy, dismissal and retirement• Maternity/Paternity pay• Training• Disciplinary procedures• Union Rights and ConsultationLabour laws are in place to cover the terms of agreement between employer and employee, Health and safety laws provide standards of working conditions that must be met by the employer. [1.2] Main features of current employment legislation include:• Employment rights – examples of legislation relating to this include; The Employment rights act, The National Minimum Wage act 1998 and The Working Time Directive 1999.• Equality and Discrimination – legislation relevant to this include; The Sex discrimination act 1975, Equal pay act 1970 and The Disability act 1995.• Health and Safety – key pieces of legislation in relation to health and safety include; The Health and Safety at work act 1974, Control of substances hazardous to Health (COSHH) 2002, Manual Handling operations and regulations 1992 (amended 2002) and The reporting or injuries, diseases and occurrences regulations 1995. [1.3] All legislation relating to employment exists to prevent the exploitation of employees by their employers, this means for example, ensuring that a safe and satisfactory working environment is provided by employers; that employees receive the national minimum wage or above, and have a contract in place stating their maximum working hours and are not made to work above them. Employment legislation protects employees from discrimination and helps to reduce the risk of occurrences such as unfair dismissal.
