1.2 – List the main features of current employment legislation.

Health and Safety at Work Act, 1974.
“All workers are entitled to work in environments where risk risks to their health and safety are properly controlled.   Under health and safety law, the primary responsibility for this is down to employers”.   HSE, 2002.

Employment Rights Act (amended by the Employment Relations Acts of 1999 and 2003).

Provides a range of contractual rights of employees including;
    • Entitlement to an itemised pay statement
    • Entitled to the National Minimum Wage
    • That the terms and conditions of work must be set out in writing
    • Protection against unfair dismissal at work.


The Equal Pay Act, 1970.
Sets out that women and men should receive the same pay for doing the same type of work or ranked as being the same value.


The National Minimum Wage Act, 1998.
Developed from a directive from the European Union.   The Minimum Wage is increased each year in line with the rise in the cost of living.

The Working Time Directive, 1999.
This guarantees all employees a maximum of 48 hours working time in a week and a 5.6 weeks paid holiday per year.   It also places restrictions on set times for breaks and rest periods.   Employees can choose to opt out of the Working Time requirement and agree to work longer hours if they wish.

The Data Protection Act, 1998.
