Should wealthy individuals be permitted to “buy” their way out of prison or bargain for a reduction in sentence? What if the individual, if allowed to remain out of custody, can continue to earn his legitimate income and therefore pay substantial restitution to the victims, but if placed in prison the victims will go uncompensated? I would rather pay a $30K fine as opposed to a year in prison because prison creates a criminal record that never goes away and in turn creates difficulty in obtaining employment, decent housing, and destroys many other opportunities. I think that in the long run that one year in prison will end up costing more than $30K in lost wages and such, so I would rather pay the fine. I think if a wealthy person has the means to pay restitution to help the family and at the same time this reduces or helps them avoid a sentence, I am ok with it.
