The criminal justice policy process reflects what is best for society as a whole and not what is best for individuals. In the American way, the political system uses a democracy to voice concerns, goals, or objectives, especially with crime in order to persuade people and gain votes. Politics and criminal justice policy face public opinion and community influences all the time. Criminal justice policy focuses on issues that affect everyone. Once crime or a criminal problem is significant to be an issue, then action to alleviate the issue becomes important (Marion & Oliver, 2012).
Other issue is what country laws should be applied and whether any foreign judgment obtained might be enforced in the court of choice. The international countries laws are the laws that need to be taken into consideration because the United States law is only upheld within the United States and not international countries. When going into a contract with international companies the Unites States must make sure the international company can enforce the contract legally. The United States must also consider the cultural and ethical differences in business transactions. What factors could work against CadMex's decision to grant sublicensing agreements?
They are named after a citizen who wrote Athens code of law. According to these laws, the state bares the responsibility of punishing those who commit crimes. Draco’s Laws called for the stiffest penalty which, for many crimes, was death. The Laws of the Twelve Tables included 12 laws. Of the 12 laws, 10 were original laws with 2 other being added at a later time.
Assess the usefulness of functionalist approaches in explaining crime The functionalist approach to analysing deviance and the causes of crime looks at society as a whole. It explains crime that the source of criminal behaviour lies in the nature of society itself rather than in psychology or biology. Functionalists such as Durkheim see deviance as an inevitable and necessary part of society and too little is unhealthy. Some also consider crime to have positive aspects for society. In this essay we will assess the usefulness of these functionalist theories, and look at how it helps us explain crime.
Do you believe that the judicial system should be based on holding people accountable for their choices (blame) or probability of future crimes committed? Explain your answer. They must defend them to the best of their ability and look out for what is best for them… Prosecuting attorneys' clients are usually the people of a specific city or country. Prosecutors are ethically responsible to find justice in a more conventional sense, and therefore serve to protect their area of practice from dangerous criminals. A lesson can be learned by looking into double jeopardy, and deciding the fate of these defendants. One can question whether or not an alleged criminal should be tried again if overwhelming evidence is found that would overturn an earlier conviction. One reason in support of double jeopardy is that the prosecutors are allowed more time to gather evidence and then
The lead profiler on any case can be someone from within or outside the department depending on the skill levels available internally and preferably, a teamwork approach to case analysis would create a continuing dialogue that would not entirely hinge on the opinion of one investigator or profiler. While it is desirable to narrow the suspect list down to a workable size for the investigators, it is also necessary to prevent personal whims from causing tunnel vision and causing the exclusion of viable suspects. The four basic skills necessary for good Investigative Criminal Profiling - investigations, forensics, psychological assessment and the application of cultural anthropology - are necessary to a complete an accurate profile. It should be recognized that experts should be consulted to fill in the gaps. A homicide investigator with limited skills in profiling might combine his skills with that of a professional profiler and as a team, increase the success of the
The background information on the Guantanamo bay and its timeline has been presented very clearly. This way the readers are not confused and understand the history very well. Hard facts such as the prisoners being denied the protection they were entitled to and the supreme court decisions denying these arguments gives the audience their evidence. This way they are also binging opposing views and downplaying them through the use of logos. However, if the authors had talked more about the past issues of Guantanamo Bay, the article would have more credibility with the use of logos.
These things are no joke. One of the greatest challenges facing the criminal justice system is the need to balance the rights of accused criminals against society’s interest in imposing punishments on those convicted of crimes. This tension is illustrated by the debate over whether defendants have the right to be represented by an attorney. Whether or not those accused of a crime should be vigorously defended by lawyers, and whether lawyers should even accept such a case in the first place goes to the heart of the issues in Criminal Justice: Opposing Viewpoints. The authors examine these topics and others in the following chapters: Does the Criminal Justice System Need Reform?
