Legal residents of Arizona are granted the option to sue if they feel a local agency’s policies interfere with the enforcement of federal immigration law. It makes it a criminal offense if an individual picking up a day laborer interferes with the normal flow of traffic. The law does not allow an undocumented immigrant to search for work in any public place. These are merely a select handful of issues within SB 1070. Once this law was announced, there was an enormous public outcry of opposition.
By doing this the government is invading the citizens privacy. Not only does everyone in America have the right to privacy but every human being that is a citizen to any country in the United Nations. The NSA say that this program is strictly for finding terrorists and preventing any future terrorism attack it still bothers many people that nothing is private. The only reason that the NSA can perform these actions is because they are a government supported program. The privacy of millions of people can be violated because the government believes its right.
Secretly placing a GPS on a car or monitoring a mans movement for long periods of time constitutes a government “search”, and therefore the mans constitutional rights were violated. They were also trying to determine whether movement in a private vehicle on city streets is "public" in nature. The officers should have announced their presence on more than just the initial entrance into the house. There has also been a violation of the defendants’ constitutional rights when government interfered with the choice of social or private lifestyle that the defendants choose to engage in. In , 478 U.S. 186 (1986), The Supreme Court of the United States held that the State of Georgia’s sodomy statute did not violate the fundamental rights of homosexuals. There have since been many decisions by The United States Supreme Court that have contradicted this holding. The defendants have a lifestyle that some people do not agree with.
One criticism of intelligence agencies that people were shocked to hear through the 9/11 Commission Report was that the Central Intelligence Agency had information on some of the suspects involved in the 9/11 plot. This information was requested by FBI agents multiple times but was not handed over because it would have jeopardized the case CIA was building against other operatives. (Soufan, 2011). The PATRIOT Act also allowed warrants to be issued in any district, whether or not the activity being investigated was being conducted in that district or not (Landahl, 2007). It also created penalties for harboring terrorists, increased maximum sentences for terrorism related activities, and most importantly eliminated the statue of limitations for terrorist activities (Landahl, 2007).
Proposition 187 called for the denial of health, education, and social services to those people who are not registered citizens of the United States, or to those who are not legal immigrants. The requirements in order for this to be carried out however were great, requiring administrators and law enforcement to check on people’s citizenship status. President Obama criticized the bill shortly before Ms. Brewer signed it. The Arizona law, he said, “ threatened to undermine basic notions of fairness that we cherish as Americans, as well as the trust between police and our communities that is so crucial to keep us safe.”(New York Times). Amendment I violations enabled by the US Patriot Act allows the government to monitor religious and political groups without suspecting criminal activity. This directly ignores the 1st Amendment stating, “Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof”. The fourth amendment guards against unreasonable searches and seizures, unless probable clause can be provided. The Arizona Immigration Law says that law enforcement officers only need a reasonable suspicion of a person to be an undocumented immigrant. Citizens of America (legal immigrants), are subjected to embarrassing and uneccassary searches if considered to “look” like an undocumented immigrant and may have some properties taken away from them since it may look like a threat to the government. The 14th Amendment prohibits state and local governments from depriving persons (individual and corporate) of life, liberty, or property based on race, ethnicity, or gender. This law should not have been passed in the first place, since it violates citizen’s right to life, liberty, and pursuit of happiness.
