Civil Rights Violation; It was avoidable Jaimie Berault March 17, 2014 CTU Online The power to relieve an individual of their liberty is an awesome power to behold; this power comes with immense responsibility. The burden of responsibility falls on the officer; the officer is the trained individual, his or her actions must be above reproach. Although federal and state standards vary in regards to civil rights violations, what is prevalent among all, is known as Section 1983, this statue of the US code states; “it is unlawful for any individual, acting under the authority of law, to deprive any person of their constitutional rights” (Office of the Law Revision Counsel, 2013). To harass, cause physical damage to any person or their property, or to place an individual in fear for themselves, their property, or that of a third person, is a criminal offense and a civil rights violation (Rahr, 2010). Racial profiling occurred when the officers singled out the Asian man in the parking lot. Their decision to pursue was a decision based solely on the fact that he was Asian. Weather this type of policing was standard procedure among their department has not been determined. However, the incident would have been avoided if simple policies were in place. Had the officers followed and observed, or followed and attempted a routine traffic stop, the situation would have had a different…show more content…
