With the defendant they get a shot at leniency from the judge. Then there are some that say plea bargaining is unconstitutional. “Plea bargaining rests on the constitutional fiction that our government does not retaliate against individuals who wish to exercise their right to trial by jury.” (Lynch, The Case Against Plea Bargaining, 2003). essentially this means if the defendant believes in their innocence and want to go to trial the will be punished for standing up for their constitutional rights. It is my belief that plea bargaining is an utter necessity, and though it may not seem just at all times; we as a society can see how hectic the court would be if all cases were brought to trial.
In the vigilantism cases, although we could all relate to the frustration involved for the actors, we all agree that one must stay within the bounds of the law to seek out justice. The next discussion involved civil disobedience and we found that we agreed that civil disobedience has been helpful historically to help change the laws and improve our society. However, the general consensus on civil disobedience was also that the acts of disobedience must be done in a peaceful manner for the acts to be effective. The final acts of crimes among professionals had another anonymous decision. Our team found that we did not agree with those professionals who chose to commit crimes.
I do believe we should not coddle them with taxpayer treatment programs that a lot of them enter and exit repeatedly. But, on the other hand, if those treatment centers do offer some sort of success, then it a good thing to offer them in hopes of the offenders not depending on drugs and having to commit crimes to get those drugs thus reducing crime, the courts, jails, and prison population. Drug treatment programs are less expensive than prisons and more effective at helping people turn their lives around. Many of the programs available to inmates are provided by organizations like AA and NA, which send volunteers into the prisons. Most of the volunteers are previous offenders who have changed their lives and now want to help other change their life.
It is risky in funding a program that we know failed once before. The money needed for this may not be worth it. e. A new development should be in place for the emergence of the mentally ill with the community by the federal government. v. Advantages: The stigma towards the mentally ill would decrease if there was an emergence into the community through institutions. vi.
If they are negative for drugs then they should still receive welfare, while still being watched and on probation for another year. On the other hand, if they are tested positive for drugs in the following year I believe they should be arrested. It’s already against the law to do drugs so it is not like we are treating them differently than any other American. Those going to jail actually may be a better lifestyle for some of them. Jail can be looked at either a punishment or a chance to change their life for the
juveniles act on emotions or wants, without thinking their actions through completely. Oftentimes, juveniles are being influenced by an adult in their life. Courts and judges should look at who made the juvenile the way they are, and the living environment that the juvenile is from. It should not be fair that a 17 year old should be treated differently then an 18 year old, if they are a repeat offender. No matter the crime or the brutality of the crime, they should still know that wont be okay in the real world so why not be made aware from an early
For that, they need to be removed from society for the society's good. Rehabilitation should be a secondary goal. It should be the goal to give the prisoner the skills necessary to make his way on the outside without resorting to crime again. This is more than just job skills I'm talking about here. There should be skills taught on resolving conflict situations, ordinary life skills, money management, etc.
Critical Analysis on “The Missing Piece to the Gang-Violence Debate.” Dan Gardner’s publish, “The Missing Piece to the Gang-Violence Debate”, is strongly controversial in his position against increasing enforcement of drug laws, and boosting penalties for violators. He believes that you should actually limit enforcement and hardship of sentencing when it comes to drugs. Was his argument persuasive enough in the essay to actually influence his wishes into society? Personally, I don’t think so. Gardner’s ideas are too drastic and I believe he didn’t have enough support in his argument that his plans would actually decrease the murders in gang violence.
Lastly, it will talk about the societal implications of abolishing juvenile court. Overview of the Juvenile Justice System The juvenile justice system was created because the justice system decided under the age of 18 a juvenile should not be held responsible for their delinquent acts. Therefore, they created a juvenile justice system to rehabilitate juveniles instead of punishing them, in the hope of keeping them from committing more crimes. Depending on the severity of the crime, the age of the offender, and amount of incidents, the juvenile court can waive its jurisdiction and have the juvenile transferred to the adult court to be punished. To guarantee the juvenile’s welfare and safety, the state statues deliver a baseline for courts and procedures they must follow when handling a juvenile in the adult justice system, called parens patriate.
Arizona confirmed that if the government has not taken any far decisions on the issue of illegal immigration, people have to do it themselves. Maybe eventually the government will pay attention to the situation in the country and will try to find a suitable solution for that. It is true that United Sates is a "nation of immigrants," however when these immigrants are breaking the law of the country they want to be in, the action must be taken to ensure the security for law abiding citizens of the country, for them to be safe and sleep calm. It is already bad, don’t wait until it will get worse and maybe even too late to repair
