Antitrust Law and the Ethical Ramifications of Generic versus Brand Name Drugs Antitrust laws are on the books in the U.S. to prevent companies from cornering the market on a specific product, ensuring fair competition and lower prices for consumers. Antitrust law dates back to 1890 when the Sherman Act was introduced to ensure healthy market competition by limiting the ability of a company to monopolize the market on a product in order to purposely limit trade (Cyprus, 2011). Other laws have been enacted specifically in the pharmaceutical market to ensure fair trade, while still allowing for companies to recoup the R and D expenses of manufacturing a new drug. In 1984, the Hatch-Waxman Act was put into law to promote generic drugs, but also leave a window of exclusivity to the original company who manufactured the drug to recoup its R and D costs (CPTech, n.d.). Many pharmaceutical companies have been involved in litigation regarding their alleged attempts to monopolize their drugs.
Summary of a Situation that Required U.S. Diplomatic Efforts during the President Reagan’s Time in Office “Doctrines were, by journalist definition, U.S. presidents articulated policies. They help us remember who stood for what. These doctrines are variations of the first one, The Truman Doctrine, sometimes called the “containment” policy, which was based on stopping communism.” (Roskin, 1999, p. 58). We should get rid of it and the police and prosecutors should be able to use the evidence even if it’s obtained in violation of the rule, because we could potentially let criminals go to satisfy this rule. This rule is so full of controversy, that it is hard to support. How can we as citizens embrace this rule? A rule that does so little to protect the law as it was made.
One of the major points against gun control is the violation of your second amendment rights, you have the right to keep and bear arms for personal protection. This paper will show there is no common sense in banning all firearms as a means gun control and it leaves law abiding citizens increasingly vulnerable to violent crimes. No Common Sense in Gun Control Over the past forty years, legislators have spent a lot of time, effort and revenue on legislation regarding gun control. Gun control advocates insist that increased gun control will lower the soaring crime rates of the early 70's. However, “recent research on the prevalence of defensive gun use has prompted growing concern that government efforts to regulate gun ownership and use may be counterproductive” (Ludwig, 2000, p. 363).
The reasoning behind writing the article “An End to the War on Weed” is to show how legalizing marijuana will solve many problems that have arisen simply because the government is trying to keep it illegal. The author, Nathan Comp, wants the readers to understand how it has been a common misconception that legalizing marijuana is a bad thing and that it will actually reap good benefits for all parties involved. Since the article talks about former and current US Presidents, as well as details border patrol surround the United States, the main intended audience for the article would be the inhabitants of America. More specifically, he
America must restore its rights and responsibilities. Prohibition does not work. There would not be a criminal market place if drugs, all drugs including designer drugs, were legal. In an article titled, “10 Reasons to Legalize Drugs” it stated that “The market for drugs is demand-led and millions of people demand illegal drugs.” Crime would be reduced tremendously. Most of the violence associated with Lind 2 illegal drug dealing is caused by its illegality.
Recent polls taken by the Pew Research Center and General Social Surveys show that the main reason for support of marijuana is that the American public fails to see marijuana has a major moral issue (Galston, Dionne 1). Compared to gay marriage or abortion, many more Americans are indifferent when it comes to others using marijuana. Those against legalization who consider marijuana to be a gateway drug and a vice argue that legalization will lead an overall increase in consumption of the drug. They argue that legalization will decrease productivity in the workplace, influence children negatively, and increase drug induced automobile crashes. However, the pro-legalization Americans respond in saying increased marijuana use has no lasting health effects, legalization will allow for better regulation of distribution, and marijuana legalization will reduce alcohol consumption in America.
To Legalize Marijuana or Not.. General Goal: To persuade Specific Goal: To persuade individual to legalize marijuana Central idea: To educate individuals on what the benefits are for legalizing marijuana. Organization pattern: Introduction Attention step: We all have an opinion on the use of marijuana. Is it safe for us on a medical view or will it get out of hand and still be abused. Thesis statement: Marijuana has been decriminalized in several states on the basis that it will benefit the sick and boost the economy. Credibility statement: Marijuana has come along way from being the illegal substance that people abuse.
Removing the incentives for legality and protection will only force more patients into underground markets. The solution is to lift the prohibition and responsibly regulate the industry. These measures involve limiting the medical eligibility for obtaining marijuana. Patients should only be eligible if they have specific conditions which truly benefit from the drug. This will avoid misuse and prohibit the expanded use.
President Barack Obama's point man for drug policy said legalizing marijuana won't solve the nation's drug problem, but addiction treatment will increase. (“Drugs”). Although, marijuana has no addictive characteristics therefore it cannot increase the addiction treatment, but instead decrease the addiction rate and it could reduce the nation's drug problem. Kerlikowske said via a recording by Minnesota Public Radio. “However, marijuana has public health consequences and it is the administration's policy to focus on evidence-based drug policy reform.
