ERR1 Understanding employment responsibilities and rights in health, social care, children and young people settings. Outcome 1: Know the statutory responsibilities and rights of employees and employers within own area of work. 1.1 Aspects covered by law: Minimum wage, hours worked discrimination, health and safety, holiday entitlements, redundancy and dismissal. Training, union rights, maternity and paternity, contract, disciplinary procedures. Health and safety laws covers the work conditions and minimum wage and other laws which set basic compensation levels. We also have the Equality Act 2010, Manual Handling Operations and Regulations, Data Protection Act, and many more. 1.2 List the main features of current employment legislation: Employment rights equalities- this states the statuary rights of employees and employers it gives protection to employees about holiday entitlements, hours worked, wages etc. Equality Act 20010 this protects people from discrimination in the workplace and society. National minimum wage depends on your age 21 and over get £6.31, 18 to 20 year olds £5.03, under 18 years old £3.72 and apprentice £2.68. 1.3 Outline why legislation relating to employment exists: Employment law exists to protect the worker and the employer, their safety and their human rights at the work place e.g. working hours, pay, breaks, and discrimination. If these laws were not in place they could be made to work excessive hours with no breaks for little pay and be sacked at any time. 1.4 Identify sources and types of information and advice available in relation to employment responsibilities and rights: Contract, manager, ACAS (advisory conciliation arbitration service), Citizens Advice Bureau, the Equality Act.
