The essay wretten by Charles R Lawrence III intilded On Racist Speech makes a good point reguarding this idea saying "Freedom of speach is the life blood of our democratic system"(Lawrence,57). Freedom of speach has been one thing that has defined America over the years. Though it may pain people up holding freedom of speach should be priorety for all Americans It is not a matter of racist speach being outlawing all togeather, but a matter of restriction. The goverment has already restricted racest speach, Lawernce explans this when he writes "but the regulation of otherwise protected speech has been permitted when the speach invades the privacy of the unwilling listeners home or when the unwilling listener cannot avoid the speach"(Lawrence,57).

What Americans do have a right to is their opinion and the means by which to express it, no matter if the opinion is favorable or not. And though the intentions behind such beliefs are made in good faith, it is unrealistic to believe the mission of filtering out racist speech could be completed without catching in the same net all kinds of other speech that is considered "OK" (Lawrence III 514). I firmly believe that a government that tells its citizens what is appropriate to say will soon be dictating what they may think also, and by that, it is unlawful for the government to regulate racist or violent speech. By doing so the government would intrude on students' creativity and learning process, would set illusive restraints on racist behavior, and undermine the Constitution at whole.

If the government were to ban this because of its highly offensive and challenging nature, the people might slowly see their freedom of speech disappear as more and more ‘offensive’ actions were banned. The framers were not ignorant to the possibility of flag burning; they formatted the Constitution to protect the freedoms of the people- including the freedom to protest the government which is supposed to strive to protect those freedoms. Though the people may be offended by these actions, we must attempt to defend the ideals the flag represents instead of their physical form; for these ideals cannot be destroyed by fire, but they can be damaged by the restrictions of the freedoms the flag represents. The Amendment proposed to ban flag desecration would affect many Americans. Strict laws would prevent all flag burning- even the respectful disposal of flags by organizations like the Boy Scouts.

Freedom of speech is, however, limited to a certain extent. Although this amendment allows a person to protest peacefully, engage in symbolic speech to advertise commercial products, not speak, or use certain offensive words to convey in political messages, there are boundaries to be drawn. Freedom of speech does not include making or distributing obscene materials, instigate or provoke actions that would harm or cause harm to others, or burn draft cards as an anti-war protest (“United States Court,” n.d.).
Torture is illegal and un-American. To spread freedom and democracy abroad, the U.S. must show the world it can do so while holding firm to our belief in the basic human right not to be tortured.
