In the case of Juwan Howard, negotiations took place to decide on how to divide or share a limited resource, Juwan Howard, and create something that neither party could do on their own, a winning basketball team. In negotiations there are many factors at play. Each party has their own agenda and has a different perspective of the benefits, costs, and risks involved in the negotiation. This paper will review the different viewpoints of the parties involved in negotiating Juwan Howard’s NBA contract. Case Summary This case involved the negotiation of an NBA contract for Juwan Howard. Howard was a 1st round, 5th pick who quickly became a wanted player. Juwan Howard knew his worth. He and his agent set out to solicit $100 million dollar contract offers. The current team that Juwan played for, Washington Bullets, failed to meet the demands. After a long negotiation with the Bullets, they ultimately would not budge on their figure that was far less than the $100 million contract he wanted. The Miami Heat had expressed an interest in Howard and was willing to meet the $100 million dollar contract. They also exceeded it with perks and bonuses. Howard was excited about his contract and the new teammates he would play with. The excitement was short lived. The NBA launched an investigation into the Miami Heat’s contracts. Under the “collective bargaining agreement” teams are not allowed to make undisclosed agreements. Every contract and agreement must be reported to the league. It appeared that the Miami Heat exceeded salary caps and made undisclosed deals with players to avoid exceeding the cap. The contract for Howard was disallowed. Once again Juwan Howard was a free agent.
