Assignment 2 – Analysis of a Healthcare Lawsuit Case Carrie Bonds Prof Wendy Good HSA 405 December 2, 2012 List the Title and Case Citation in proper legal format Juror’s awards Waverly family $55 million in Hopkins malpractice case 2012 Baltimore City Circuit Court decision in Enzo Martinez, et al vs. John Hopkins Hospital, et al (2012) Describe the facts of the legal case chosen. The facts for this case are disturbing. Mr. Martinez and his wife, Rebecca Fielding chose to have a midwife come to their home to deliver their first born. On March 2010, Rebecca started having complications after hours of labor trying to deliver her son at home with her midwife that caused her to be rushed to the hospital in an ambulance on a stretcher. Mrs. Fielding tried to assure her husband that everything would be okay. When she arrived at the hospital, Mrs. Fielding and Enzo waited two hours for Rebecca to receive a Caesarean section. For some reason unknown, the nurses and doctor were unable to perform this procedure at the time she arrived. Not knowing that during the time she was waiting in the hospital, her unborn son was losing oxygen. Their son suffered from loss of oxygen to the brain during his birth, and was born with severe and permanent developmental delays, severe and permanent brain damage, multiple physical and mental disabilities, and Cerebral Palsy (Wenger & Rector, 2012). Describe the issues of the legal case. Some issues that arose during this preceding were that the defendant, John Hopkins Hospital, did not think that they were responsible for the child’s brain damages. According to Gary Stephenson, Director of Media Relations and Public Affairs, he stated that Hopkins worked appropriately and in a timely manner to perform the procedure of the C-Section.
