This had obviously been very difficult time and I was aware that the birth of a new baby within the family may have come with mixed emotions. SCENARIO Prior to the visit I had received a telephone handover from the new Mother’s midwife, who had explained this had been an uneventful pregnancy and straight forward delivery. However her sister had very recently given birth, which had tragically resulted in the baby dying shortly afterwards. The midwife explained this had created anxieties about her new baby and that whilst she appeared to doing okay it was something to be mindful of. Open versus Closed Adoption As a nursing student, I have had the opportunity to speak with high school students about the issues of teen pregnancy and parenting. One student in particular confided that she was having trouble deciding whether she should put her unborn baby up for adoption. This conversation prompted me to investigate the legal and ethical issues facing parents who decide to give their child up for adoption. Primarily, I wanted to understand the options available to the birth parent, and also, to weigh these against the legal arrangements in the best interest of the child. An adoption takes place for several reasons, as a result of an unwanted pregnancy, lack of a proper home environment or numerous other reasons.

Much debate exists in the international community as to the justification for intercountry adoption and how to best ensure the well being of children around the world. This analysis will illustrate a brief historical account of intercountry adoption and how this practice has come to be, explore the various arguments in support and opposition of intercountry adoption, then turn to existing international law relevant to the issue.
