C3443040 ETMA04 Question; For the purpose of this question we would like you to imagine that you are working as a trainee criminal defence solicitor. The partner supervising your training has asked you to review and advise in the following three scenarios: In scenario 1, advise whether the Crown Prosecution Service should go ahead with prosecution against Shantel In scenario 2, advise whether the arrests of Amrit and Crystal are lawful. In scenario 3, advise whether the arrest of Paige is lawful. In this assignment I will be taking the role of a trainee criminal defence solicitor and being asked by my supervising partner I will be reviewing and advising on three different scenarios. Scenario 1 On the night when Shantel her twin sister Amber and their friend Madison have been out celebrating the end of their college exams, they have dress up identically and have gone into a nightclub. As leaving the club the girls are very drunk and they are involved in a fight with another group of girls. Amber and Shantel are knocked to the ground. While later a paramedic Jennifer arrives from a waiting ambulance and she tries to help Shantel to get up, seconds later she has been kicked in the stomach and falls backwards, hitting her head on the corner of the litter bin causing a cut to the back of her head. The police arrives an arrests Shantel on suspicion of assault occasioning Actual Bodily Harm (ABH) contrary to section 47 Offences Against The Persons Act 1861. There have been witnesses which confirm that Jennifer being kicked and falling backwards including a young gentleman Zac which is Shantel's ex-boyfriend, he confirms that he has seen Shantel kicking Jennifer.
