MEMORANDUM To: Professor Meegan Zickus From: Sylvia Y. Thomas Date: December 14, 2013 RE: Unemployment Compensation Claim for Natalie Attired. [STATEMENT OF FACTS] Natalie Attired filed for unemployment compensation in July 2010, and was denied benefits by the New Mexico Employment Security Board. She was terminated on the grounds of exhibiting the behavior of “misconduct”. Ms. Attired worked for Biddy’s Tea House for about three months. During this three-month period, Ms. Attired mentioned to another employee that her boyfriend wanted her to get a tattoo. The employee cautioned Ms. Attired that would not be a great idea because if the tattoo were visible she would possibly be fired. During the period that Ms. Attired was employed with Biddy’s Tea House, she received four evaluations that were favorable.…show more content…
Attired decided to proceed with getting the tattoo in June 2010. The tattoo covered the entire upper right arm. Ms. Attired was told by Ms. Biddy (the owner) to remove the tattoo and if she did not remove it, she would be terminated at the end of the week for misconduct. Ms. Baker further indicated to Ms. Attired that “more mature” clientele would be “appalled and disgusted” by the tattoo and would lead to a decline in sales. Furthermore, there were two longtime customers that made a request to be moved to another table and be served by another server because they were insulted by the sight of Ms. Attired’s tattoo.
