Our right to carry concealed handguns is guaranteed by The Second Amendment of The US Constitution, it states “A well-regulated Militia, being necessary to the security of a free state, the right of the People to keep and bear arms shall not be infringed.” The right to obtain a permit to carry a concealed handgun is permitted in all states, excluding Washington D.C. As long as The Second Amendment is in place we will continue to have the right to bear arms. 2 Even though there are several pros to carrying a concealed weapon, with anything comes the cons and someone who’s against it. In “Accident, Analysis and Prevention” (2001), several peers with PhD’s conducted a study and concluded “Approximately 50 people are unintentionally shot each day in America and a child under 15 years of age dies every other day from unintended gunfire”. It is also argued
Webster’s American English Dictionary, 2nd Edition, defines right as “something to which one has a just claim”, while the second amendment states that citizens have the right to keep and bear arms, this have been the source of much controversy regarding gun ownership and rights (“Right” def. n.2). The Second Amendment of the United States Constitution was written in 1871 and states that the right of the people to keep and bear arms shall not be infringed. There is much information available today regarding using one’s rights or lose them. Gun control is a constant topic in the media and for politicians.
The Second Amendment was designed to guarantee the ability of law-abiding citizens to own and use firearms for legal purposes (The National Rifle Association Institute for Legislative Action, 2010). Even with the current gun control laws and their supporters, there are associations opposing against any and all types of gun control. The opponents of gun control, such as the National Rifle Association, argue that the “right to bear arms” is their guarantee under the Second Amendment of the Constitution of the United States of America. This association also argues the licensing restrictions
The opponents of these laws say that Americans have the right to bear arms. They believe that the laws would stop individuals from defending their property of themselves. The significant disagreement that opponents argue is that the right to use and own weapons is a personal freedom promised by the Constitution. Individuals against gun control also think that certain people should not be allowed to own guns but also think that stricter laws can stop the needless loss of life. The debate over gun control has been one a main topic since the 20th century.
At the time it was written also in 1791 this was relevant as the British forces still strong in the colonies were taking over homes and towns to intimidate the locals and the government saw it fit to enable them to defend themselves. In America it is relatively easy to get numerous guns legally which would probably explain why it’s the world capital for gun crime. This would be considered as an out of date amendment however due to the American far right and the constitutionalists changing this would be impossible. Another way to formally amend the constitution is by calling a convention “for proposing amendments”. For the bill to be “ratified” a ¾ majority in all states must be reached.
Gun control laws have become such a huge controversy in the United States due to the fact that citizens believe their Second Amendment right is being taken away from them. In my eyes, I believe that extended gun control measures should be taken to ensure that access to assault weapons should be limited to certain people. I believe one deserve a well rounded background check to see if any mental health issues are visible. I also believe you have the right to own a weapon and the government is not trying to take away your hunting rifles, personal permitted handguns, etc. They government is emphasizing more on the fully automatic weapons, explosives, armor and other things that only the military should have access to.
Controversy with the Second Amendment As law abiding American citizens, we have the right to bear arms as stated by the Second Amendment of the United States Constitution. This Amendment was enacted to ensure that our founding fathers and their descendants had the means to protect themselves, their family and their property. Although this is a legal right, there is heated controversy as to whether it is an ethical right. Typically, the gun debate inflates shortly after a mass shooting like the recent incidents in Aurora and Newtown. The argument is usually the same: one side insists that if officials eradicated guns, thus abolishing the Second Amendment, gun violence will somehow go away.
Should people have the right to bear arms? George Washington once said, “Firearms stand next in importance to the Constitution itself. They are the American people’s liberty teeth and keystone under independence.” Americans need to fight to keep the second amendment. Gun ownership is necessary for self defense in your home and on the streets and to decrease crime in communities and neighborhoods; and taking away the Second Amendment will make America less of a free country. Eliminating the second Amendment will make it harder for law-abiding citizens to protect themselves against psychos with guns.
This amendment was adopted on December 15, 1971, such as the other bill of rights. After the court case with District of Columbia v. Heller in 2008, the court ruled that you may posses a firearm even if you are not in any militia or army and to use that firearm for lawful purposes only, such as self defense and home protection. In McDonald v. Chicago court case, the court that the Second amendment limits the State and local government to the same extent as the federal government. When they adopted this amendment way back in the late 1700s, it was made for the militias that were made to fight in war. So they may fight in war and protect themselves, home, and family members.
So as you can see from where they stand Obama is a little more for Gun Control while McCain is almost completely Agenst it. My opinion on this issue is that it is our constituional right to have these fire arms and that we should be able to keep them. I had a history teacher tell me once that the one admendment is the only one that keeps the government on edge and doing what the population wants cuz it gives us the power to rebel if the government stopes listening to us. Also I think that if they do band guns like they do in other country’s all they are going to accomplish is taking the guns out of the good guys hands and giving the bad people who will not turn theirs in a free
