The argument against gun control has many facets that are either illogical or contain a plethora of logical fallacies. One of such fallacy is the use of the Second Amendment. It has been misconstrued over the years to change what its original meaning was. The text of the second amendment is as follows: “A well regulated militia being necessary to the security of a free state, the right of the people to keep and bear arms shall not be infringed.” The various proponents of anti gun-control, gun enthusiast and NRA alike, tend to cite this amendment as a safety net to all of their arguments. The exact court case that brought this decision was, United States v. Emerson, it changed the scope so that the second amendment was not a collective protection for state run militias, but rather a safety net for all the gun lovers and proprietors. The new definition did not make reasonable gun control unconstitutional. Many states have created have laws preventing any felons from using or owning guns of any type. On top of this there are locations where guns are not allowed. With this there is also a ban on the dangerous assault weapon. Many of the gun enthusiast provide a middle ground. The say that what is a good idea is not the blanket ban of guns, which is unconstitutional because of new meaning of the second amendment, but rather a continuation of the current limits of guns and gun owners. It may not be “constitutional” for the government to put a complete ban on weapons, but it is proper for it to enact stronger restrictions to keep the rather terrifying weapons away from the people who cannot be trusted with a knife, much less than that of a
