State of Confusion Tanya Trucker plans to file suit against the state of Confusion because the state of Confusion enacted a statute requiring all trucks that use its highways to use a B-type truck hitch. Trucks typically use a type of hitch to ensure safe travel from destinations at times pulling large cargo. This statute would negatively affect Ms. Trucker’s business, and she hopes to overturn the statute in a civil suit against the state. With the aid of a hired attorney she can take the first stage of her civil suit, which is to start the case by filing the initial court papers. Ms. Trucker’s lawyer will then conduct research against the plaintiff’s case, which will be sent to a Federal District Court in the State of Confusion. The…show more content…

According to TITLE 28 > PART IV > CHAPTER 81 > § 1251 of the U.S. code (a) The Supreme Court shall have original and exclusive jurisdiction of all controversies between two or more States. (b) The Supreme Court shall have original but not exclusive jurisdiction of: (1) All actions or proceedings to which ambassadors, other public ministers, consuls, or vice consuls of foreign states are parties; (2) All controversies between the United States and a State; (3) All actions or proceedings by a State against the citizens of another State or against aliens. The basic statute effective at this time in conferring and controlling jurisdiction of the Supreme Court may be found in 28 U. S. C. §1251 et seq., and various special statutes (Supreme Court of the United States, 2009). It is clear that the US Supreme Court has absolute authority on the final matter on this case. The likelihood that Tanya Trucker may very well find her case in the US Supreme Court with a good chance of winning the case. In the meantime, she will still have to pay the additional expenses in acquiring her drivers to install the B-type hitches or pay the fines, or provide means of going around the state of Confusion. Tanya is likely to prevail in her pursuit against the state of Confusion’s new statute, but in the long term other manufactures must be allowed to sell the B-type
