(Crafting & Executive Strategy, 2011 pg C-229). It was also believed that passing the law by FCC will prevent upstream ISP Companies like AT&T from restricting what VOIP companies like Skype’s customer can do on the internet which has been generating issues and lost revenue for Skype. But if the law was not passed and the upstream ISPs and smaller ones were allowed to make their own decisions, they could charge extra for access to certain websites and even restrict access to some others. ANALYSIS The industry segment is faced with a rivalry type competitive market that is currently being influenced by federal government through the Federal Communications Commission (FCC). This agency is considering a new law (Network Neutrality) on the websites that would decrease the power of big telecommunications companies like AT&T.
SimilarThe Telephone Consumer Protection Act of 1991 (TCPA) was created to regulate solicitors to provide the identity of their business and contact information; and, to eliminate nuisance telephone calls (http://transition.fcc.gov/cgb/policy/TCPA-Rules.pdf). Congress passed the law to restrict solicitors by the means of using automated generated calls throughout the day and night and continuously calling consumers despite notification to stop calling. The act generated the Do Not Call Implementation Act of 2003 which offers multiple regulations of solicitors and limits random solicitation. The act was established to curb unwanted calls to consumers who felt harassed by telemarketing tactics. The act also restricts solicitation by facsimile and text messaging.
The proper value criterion for this round will be providing security. With providing security we can achieve morality because if the people of the United States are not safe, then the government should be doing more in order to assure that they are secure. Contention 1: If individuals willingly make private information public, there is no longer a reasonable expectation of that privacy Subpoint A: There is not a right to privacy for information disclosed to third parties When people go online, they are disclosing information to a third party, such as the service providers and corporations like yahoo and google. These are companies that the government is requesting information from. If this is the case, it seems logical that they can
The FTC addresses this type of advertising as Bait and switch. In Section 5, 12 and 15 there are specific guidelines for businesses to prevent the partaking in this type of deceptive advertising. According to the FTC, “it is illegal to advertise a product when the company has no intention of selling that item, but instead plans to sell a consumer something else, usually at a higher price” (Facts for Business). After seeing the way the salesmen was acting in regards to the advertisement it makes it obvious that the advertisement was placed only to lure customers in. This is made even more obvious by the change in Tony’s mannerism when Betty threatens to bring legal action to the dealership.
According to Larry Greenemeier, a recent court case, Carpenter V. United States "specifically pits the privacy of information that wireless devices share with their service providers-the towers or " cell sites" devices connect to, the phone numbers they call and answer, and the time and length of those calls-against law enforcement's authority to retrieve that data without a warrant." However, the FBI issued court orders under the 1986 SCA in order to compel carriers to turn that information over to the FBI. This would be acceptable despite the fact that a warrant requires more reasoning to receive. If they felt strongly enough that they had reason to obtain certain information, they should have to convince a judge to see the situation from the same point of view. “ Without a warrant, but with the SCA court order in hand-the FBI compelled MetroPCS to provide about four months of location records for a smartphone owned by suspect Timothy Ivory Carpenter.” Based off of the information the authorities had previously, it would not have been hard to convince a judge to issue them a warrant.
The Monroe Doctrine The Monroe Doctrine is a US policy originated by President James Monroe. This policy stated that European countries should not try to colonize any of the developing countries in America, and if they do so, we will defend these countries by any means possible. In my opinion, the United States does not still follow this policy. America is very involved with other countries today, and we need to trade with other nations to get important materials such as gas and oil. Also, America is usually willing to help other countries because some of those countries may be able to help us in return.
My partner and I disagree with the resolved: Unilateral military force by the United States is justified to prevent nuclear proliferation A few definitions to set the stage for the debate: Unilateral- a unilateral action or decision is done by only one of the groups involved in a situation. <http://www.ldoceonline.com/Government-topic/unilateral> Justified- Demonstrated or proven to be just, right, or valid. <http://www.answers.com/topic/justify> Prevent- to stop something from happening or someone from doing something. <http://dictionary.cambridge.org/dictionary/british/prevent> Nuclear proliferation- a term used to describe the spread of nuclear weapons and weapons-applicable nuclear technology and information, to nations which are not recognized as "Nuclear Weapon States" by the Treaty on the Nonproliferation of Nuclear Weapons, also known as the Nuclear Nonproliferation Treaty or NPT. < http://definitions.uslegal.com/n/nuclear-proliferation%20/> In order for the Pro to win this debate, unilateral military force by the United States must not only be proven to effectively prevent nuclear proliferation, but also be justified.
It is a person’s own responsibility to make decisions about what websites and/or content are appropriate or not. If a person is not sure as to what the content is, and if they want to view it, they can take the personal risk of entering the website. Any material should not be censored just because people cannot make decisions about a website. Thomas Jefferson said
As mentioned earlier, there is an exception for Bona Fide Research. An institution can disable filters for adults in the pursuit of bona fide research or another type of lawful purpose. However, the law provides no definition for exactly what is a “bona fide research”. However libraries are required to adopt an Internet use policy providing for unblocking the Internet for adult users, without a requirement that the library inquire into the user's reasons
Moreover, the chat on the cellphone is what distracts people. If texting while driving is eventually banned in the United States, could it be enforced? Some argue that police cannot enforce drivers who text. Although, this method is direct there is another strategy that enforces drivers who text. The high visibility mobilization strategy is a method that the government uses to aware people of new laws.
