AFFIRMATIVE DEFENSE I have found some cases that can be utilized for defense purposes and also key parts of the Motor Vehicles Act. Pitezel v. Danielson No39369…following too closely and failure to keep proper lookout State v. Darrah No54389…failure to wear proper safety gear in the form of a motorcycle helmet Woten v. Day NoWD35290… failure to keep proper lookout... (contributory) Mo. Rev Stat. §304.015(6) Supp 1971…Prohibits driving in left lane when not passing other vehicles Per the MOTOR VEHICLES ACT: 144(1)(a) Careless Driving: a person must not drive a motor vehicle on a highway without due care and attention. 145(1) Slow Driving: a person must not drive a motor vehicle at so slow a speed as to impede or block the normal and reasonable movement of traffic except when reduced speed is necessary for safe operation or in compliance with law.
Freedom of Choice Thesis: The current helmet law in Kentucky should be revised for riders with their license who are under the age of 21 because it is discriminatory, as it targets age rather than the abilities of a motorcyclist, the unfair restrictions of motorcyclists versus automobile drivers, and helmets are uncomfortable and can be dangerous to the operator of a motorcycle. Outline: Kentucky helmet law discriminates based on age. {text:list-item} {text:list-item} {text:list-item} Restrictions on motorcyclists are unfair versus automobile drivers {text:list-item} {text:list-item} Helmets can be dangerous to rider {text:list-item} {text:list-item} {text:list-item} Conclusion:
In the article “Auto Liberation,” Brent Knutson discusses the need for national speed limits on U.S. interstate highways. Specifically, Knutson argues that speed limits are unnecessary based on his experience driving on German autobahns. He claims that American speed limits violate on the freedoms of Americans. Also, he says that nowadays automobiles are able to travel safely at high speeds, and speed is not the cause of accidents but “[it] combined with incompetence, alcohol, or hazardous conditions is dangerous” (Knutson paragraph 9). Moreover, Knutson states that an “intensive driver-education programs, stringent licensing criteria, and public-service announcement campaigns” can make the Americans drive responsibly on the road and he believes the main reason to repeal speed limit is “driving fast is enjoyable.” Surprisingly, the accident rates declined constantly since the interstate speed limits were increased.
In September 2014 B.C.’s tough anti-drunk-driving law passes constitutional in the provincial Supreme Court. The tough drinking and driving laws that were discussed in the P.E.S.T.E.L. above have been taken to the court to object these laws as being to harsh on the residents of B.C. They chose to keep the tough laws in place because it did not contravene chapter 8 of the Charter of Rights and Freedoms. They also mentioned that the laws have caused, “90 lives saved and a 52% reduction in alcohol-related motor vehicle fatalities.” An appeal will be placed again but as of now the harsh drinking and driving laws are here to
For example, seeing a car driving towards us in heavy rain from a distance is one stimuli. We already see the car driving or coming our way. But, not knowing the difference when it get nearer to us or not been able to judge the distance between the car and us, will result in a fatal accident. This ability to notice the minimum difference between two stimuli required to detect 50% of the time is known as Difference Threshold (Gibson & Walk, 2001). Sometimes the decision made by us are correct and sometimes they are alarmingly wrong.
As freeway lane selection algorithm is considered to be a best algorithm for traffic simulation models. It is developed under NGSIM program. It is the most precise algorithm for decision making. According to the earlier research the results obtained by using Bayes classifier and decision tree are not sufficient for accurate lane change and resulted in a traffic crash or accident. Thus the use of freeway lane selection algorithm made this possible to make a lane change with higher accuracy.
A smart road is a road that has an IT system that communicates with the IT system that is found in smart cars. The smart road communicates potential dangers to the smart car such as the recommended speed, if there are any obstacles in the way, the amount of traffic, etc. C. What are the foreseen benefits of smart cars and smart roads? Major safety increase for automobiles because the smart cars and roads would give information that would greatly reduces the chances of accidents. The major reason for accidents is speeding and smart cars would warn the drivers when they are going too fast and tell them to break.
