Under the Americans with Disability Act disability has three meanings. A person who has a physical or mental impairment that substantially limits one or more major life activities, has a record of such impairment, or is regarded as having such impairment. They are covered because this Act applies to private and public sector employers with fifteen or more employees. However, it does not apply to most federal government employers, American Indian tribes, or bona fide private membership clubs. In management this situation occurs all the time and you have to be prepared on how to handle these types of situations. An example witnessed at Wal-Mart would be when an associate cut his thumb with his box cutter while he was stocking. Of course he was taken to the emergency room for medical care. This associate received five stitches in his thumb and could not perform his regular job duties of stocking the shelves, because it required the use of both of his hands to include the thumb. Wal-Mart Inc is a company that has several jobs codes available, so while he was placed on restriction the company placed him in another job code. He was given a bona fide job as the people greeter until he could return to work with a full medical release. This is an example of an employer following the 2nd meaning stated in paragraph one, “when an accident occurs, an employer is required to make a reasonable accommodation to the known disability of a qualified applicant or employee if it would not impose an “undue hardship” on the operation of the employer’s…show more content…
This employer discriminated on me because I was a pregnant female. First I lost my job at Brinks Home Security corporate as a programmer because I was pregnant and sick all the time. I was very sick and place on bed rest periodically. I had headaches and lots of chest pain. I was fully released from bed rest when I was about six months into my pregnancy. I was laid off a week after that for performance. Never had a problem the three years before the pregnancy, now all of sudden I had performance issues. I left quietly because I knew that getting upset would only harm my baby. I began to look for jobs immediately. I knew that I was qualified for programming jobs and because of my resume and experience I received lots of calls and interviews. It was a very difficult time for me. I knew that when I went to the interview they would see that I was pregnant and the interview was basically over. I knew that it would be difficult to find a job, but some companies would take one look at me ask me a couple of questions and send me out the door. Some would even ask me when my baby was due to be born, others would asks me if I had a husband, I mean it was very obvious that these employers did not want to hire me because I was pregnant and a risk to their companies.
