Homicide in criminal law according to Blackstone is the killing of a human being by another human being. Corpus delicti is a Latin term which generally means ‘’the body of the crime’’. Latin for the substantial fact that that a crime has been committed , and in popular crime jargon , the body of the murder victim. From western jurisprudence, the term refers to the principle that a crime must have been proven to have occurred before one can be convicted of committing that crime. Black Law’s Dictionary (6th ed)defines ” Corpus delicti” as “the fact of a crime having been actually committed.’’ The prime purpose of this principle is prevention of wrongful convictions. The Corpus delicti rule was initially developed more than three hundred years ago in England to prevent the conviction of innocent accused and those with legal defences to crimes commited such as coercion, legal provocation, mental illness (insanity) or self defence. By the end of the nineteenth century, the corpus delicti rule had been adopted in some for form by almost all American jurisdictions. Corpus delicti is one of the most vital concepts in homicide cases. The Latin word corpus ought not be misinterpreted as a literal body rather than figurative one. One can still be charged with homicide even though the physical body is physical absent or has not yet been discovered, it is possible to prove a crime occurred if sufficient circumstancial evidence is presented to prove guilt beyond reasonable doubt. In the event that a person disappears and cannot be contacted, it follows norm that police agencies initiate a missing person case. If the course of investigation , it is believed the person was murdered, then sufficient evidence and strict proof must be garnered for one to be charged with homicide.
