I think it was good that Virgil did not respect Gillespie because Gillespie was using Virgil for his scapegoat. At the end of this story Gillespie finally showed everyone that he respected Tibbs by telling every one the truth about the murder investigation, and giving most of the credit to Virgil. October 2, 2012 Case Brief Cupp v Murphy 412 U.S. 291 (1973) Facts: Daniel Murphy was convicted of murdering his wife in the second degree. After he found out of the murder he called the police and voluntarily submitted himself to questioning. In the middle of his questioning the police noticed a dark spot on his finger and they asked if they could get a sample and he refused. The police did not respect his wishes and they took the sample anyways of what was under his fingernail. They processed it and later found out there was traces of his wife’s nightgown, skin, and blood all from the deceased victim.

February 26, 2012 marked a highly controversial day in history; a day in which an unarmed African-American, 17 year old, Trayvon Martin, was fatally shot and killed by George Zimmerman, a neighborhood watchman of a gated neighborhood in Sanford, Florida. The essence of the case was that Martin way walking home from a 7/11 store, after purchasing a skittles and drink, it was during that time that Zimmerman saw him and called 911 reporting a mysterious young black male in a hoody who looks like he was up to no good. Zimmerman was instructed by the 911 operator that they do not need him following the suspicious male (Martin), however, Zimmerman continued his pursuit, and later reported that he only got out of his car to give the authorities a physical/location address. He claims to have been jumped and pummeled, by Martin, who repeatedly knocked his head into the ground. Martin was alleged to have reached for Zimmerman’s firearm and at that point was shot once in the chest.

The difference here is that excusable homicide is when someone never intended to kill and justifiable homicide there was the intent to kill but it was justifiable. When one proves a homicide has been committed then it is the responsibility of the investigator to identify the victim. This can be done most easily by asking family and friends or by simply finding identification on the victim. There are also several other ways that one can identify a victim these included but are not limited to; fingerprints, DNA, dental and skeletal studies, clothing and laundry marks, and missing persons files. Several good indicators of a homicide are no GSR or gun shot residue on victim, angle and location that rules out self infliction, shot through clothing, and no weapon present.

Could the reckless murder of thirty two innocent people and the wounding of twenty five been prevented if some more precautions were taken? It is very hard to say because of the arbitrariness of the event but one cannot help but think of the safety of your own college campus when associated with Virginia Tech.
