Legislation: Children Act 1989/2004 The Children Act 1989 is a piece of legislation intended to ensure that the welfare of the child is paramount. It describes the responsibilities of professionals and parents/carers who must work to safeguard and promote the welfare of children and protect the children from harm. The Act contain information about the child’s legal position and to give him/her equal rights. It includes the requirement for services to work more closely, share a database with information relevant to the safety and welfare of children, earlier support for parents who are experiencing problems.

The Children Act 1989 and 2004 This act includes two sections that focus on child protection: * Section 47 – the local authority has a duty to investigate a reasonable suspicion that a child is suffering or likely to suffer significant harm * Section 17 – services must be put in place by the local authority to safeguard and promote the welfare of children within their area. This act also provides the legal framework for Every Child Matters (and earlier piece of legislation). Working Together to Safeguard Children (2010) These guidelines set out the Common Assessment Framework (CAF) which deals with the duties of organisations and how they should work together. Education Act 2002 This tackles the responsibilities of local education authorities, governing bodies, head teachers and all those working in schools to ensure that children are safe and free from harm.
Local Authorities have ‘a duty to investigate when there is a reasonable cause to suspect that a child is suffering or likely to suffer significant harm’. The Education Act 2002 outlines the responsibilities of Local Education Authorities (LEAs), Governing bodies, head teachers and all those working in schools to ensure that children are safe and free from harm. The Children Act 2004 highlights the need for all agencies involved in children’s services to work together to improve the well-being of children and young people. It is the responsibility of teachers and teaching assistants to be familiar with and implement policies regarding safeguarding children. The Every Child Matters agenda defines what is meant by the ‘well-being’ of children through the five outcomes that schools and teachers aim for every child to reach: be healthy, stay safe, enjoy and achieve, make a positive contribution, achieve economic well-being.

Codes of Practice: The special Educational Needs Code of Practice 2001 This outlines government guidelines for policy, procedures and responsibility for children with SENs.
This implies that the main focus of a child carer should be identifying the needs of children. Working Together to Safeguard Children 1999 Sets out how organisations and individuals should work together to safeguard and promote the welfare of children and young people in accordance with the Children Act 2004. It is important that all practitioners working to safeguard children and young people understand fully their responsibilities and duties as set out in primary legislation and associated regulations and guidance. UNN Convention on Rights of Children 1998 Ensure that children are safe and looked after, children have the right to be protected from all forms of physical or mental violence, injury or abuse,
Safeguarding a child or young person is also to ensure that they have the outlook to achieve their true potential and have the right to be protected from abuse, such as: Physical abuse Sexual abuse Emotional abuse Neglect Exploitation This also shows the consequence of shared responsibilities as there can be many different agencies involved in dealing with each case. unit 4227-071 1.1 explain how current and relevant legislation and policy affects work with children and young people: The United Nations Convention on the Rights of the Child 1989 - which ensure that children are safe and looked after, children have the right to be protected from all forms of physical or mental violence, injury or abuse, neglect, negligent treatment, maltreatment or exploitation including sexual abuse by those looking after them. This is used in residential care to ensure that children and young people are safeguarded and are given the right amount of care that they need, ofsted will look at how well children are looked after in any setting where a child is being cared for outside their home setting.if standards are not met then the home will either be shut or given tasks to improve the quality of care that children and young people are recieveing. Children Act 1989 - Parents and professionals must work to ensure the safety of the child. (Article 19 UNICEF Rights of a Child) Everyone has a responsibility to take action if they are worried about a child’s welfare. The All Wales Child Protection Procedures are an essential part of the wider agenda of safeguarding children and promoting their welfare. The common standards they provide guide and inform child protection practice in each of the 22 Local Safeguarding Children Boards across Wales.
