Groupe Roussel-Uclaf has announced its intention to distribute RU-486 in the US. There are only two modes of legitimate entry to the market: drug approval through FDA or qualification under an importation exemption for “life-saving” medications. If made available in the US, RU-486 will make abortion more accessible, a trend which runs counter to the Republican’s pro-life platform and the administration’s desire to eliminate use of federal monies for abortion-related activities. A Republican appointee, FDA Commissioner Young must prevent RU-486 from entering the market. Thomas v. Union Carbide Agric. Products Co. 473 U.S. 568 (1985) Judicial History: Under the authority of the Environmental Protection Agency (EPA); Federal Insecticides, Fungicides, and Rodenticide Act (FIFRA), manufacturers were required to register their pesticides. EPA had a “me-too” process that allowed for the pesticide equivalent of generic drugs. Monsanto Corporation sued because EPA was making them publicize trade secrets, which they claimed was a taking. Congress reiterated in Section 3(c)(1)(D)(ii) of FIFRA that EPA should make administrative decisions about how much money these manufacturers would get for damages from loss of their trade secrets.
The prices of inputs is an imperative example. Tylenol is a synthetic drug, meaning that it cannot be found in nature. Since it must be made in a lab, there are other substances which must undergo reactions to create Tylenol. If the price of these precursor substances were to go down, there would be an increase in supply. Similarly, a decrease in supply would be a result of the

Some physicians prescribe Neurontin for, “off-label”, uses such as insomnia, migraines, bipolar disorder, and restless leg syndrome. In some cases off-label uses often exceed the intended use, which in turn becomes very profitable for the pharmaceutical manufacturer.
