A Public Administrator is an elected official appointed by the governor for a four-year term. The person holding this position primarily aims to achieve public good by ensuring social justice. Overall the role of a public administrator entails substantial ethical and sociological aspects.
When ordered by court, a Public Administrator acts as a personal representative to protect the estates of individuals who have died and do not have a will or there is no heir available or suitable to serve. In such situations the Public Administrator has the same powers and duties as other representatives of deceased and can act with that authority until he or she is discharged or terminated by order of court. The Public Administrator’s primary role is to protect the decedent’s property from waste, loss or theft. As part of their custodial and administrative responsibility, a Public Administrator is required to conduct thorough investigations to identify all assets of the deceased, pay the decedent’s bills and taxes, and ensure that the estate is administered according to its owner’s wishes. The Public Administrator is responsible to ensure that individuals entitled to inherit from the estate receive their inheritance. The Public Administrator is also required to make appropriate burial or cremation arrangements for the deceased. A memorial or religious service may also be arranged under some circumstances.
A Public Administrator may also be ordered by court to care for minors, mentally or physically incapacitated or disabled individuals when there is no legal guardian or conservator or when no one competent to assume such duties is known or can be found. Public Administrators may also be appointed in cases where physical or financial abuse has occurred and family members themselves are the perpetrators.
