To: Ted Moore, CEO Teddy’s Supplies From: Greg Bodkin, GB HR Services RE: Appeal on Pollard Case Please let this memo serve as our response to your request to review the facts in the case currently on appeal regarding the alleged sexual harassment of Virginia Pollard and the potential liability that your company could be facing. We will try to summarize as specifically as possible what liability you are exposed to, our best guess as to the likelihood of being found liable, as well as our estimate of the “worst case” scenario of the damages that may be awarded to Ms. Pollard. Our belief is that Ms. Pollard will argue that there were several violations of Title VII of the Civil Rights Act of 1964, which prohibits discrimination in the workplace based on several factors, including gender. The CRA of ’64 has been expanded to include “hostile environment” workplaces, defined as discrimination in the form of unwelcome verbal and/or physical conduct related to a constitutionally protected classification (gender, race, sexual orientation, etc…). Our best guess is that Ms. Pollard’s attorneys will base their argument on the precedent found in SCOTUS case Faragher v. City of Boca Raton (97-282) 524 U.S. 775 (1998).
