Health & Safety Legislations relating to health and safety in social care settings: Health and Safety at work act 1974 Management of Health and Safety at Work Regulation 1999 Health and Safety (first aid) Regulation 1981 Manual Handling Operations Regulations 1992 Reporting of Injuries, Diseases and Dangerous Occurrences Regulations 1995 Working Time Regulations 1998 Care Standard Act 2000 Food Safety Act 1990 and Food Hygiene Regulations 1995 COSHH Health and Safety policies and procedures protect people using social care settings by setting a standard and procedure to how people should work, for example employers must have certain training in place such as manual handling which enables staff to assist residents to transfer in such a way that prevents them both from harm, not only do these policies and procedures protect the people using…show more content…
A manager is responsible for keeping policies and procedures up to date and a care worker is required to follow them. An example of a situation where the responsibility of health and safety lies with the individual receiving care could be, a resident carelessly discarding a cigarette in the smoker’s room provided for them which has the potential to set a fire. It is then their responsibility to inform a member of staff so that the situation can be resolved before it becomes a serious health and safety issue. Use of equipment such as hoists and stand aids are potentially dangerous if they are not used correctly, for this reason it is important that staff receive the correct training in order for them to work safely, it is of most importance that members of staff who haven’t received the correct training do not attempt to use equipment as they could potentially cause harm to service user, meaning they are then responsible for the damage that is caused which they could then be prosecuted
