“Do and should law and morality overlap? Give specific examples where they do and do not overlap”. What is law and moral? Law is a body of rules that binds people with a certain degree that keeps the society in an appropriate form and has to be obeyed. While, morals are beliefs and understanding of the society to determine which is right and wrong. Morals can be vary from time to time, depends of the acceptance and the ways of thinking of the people. However, do and should law and morality overlap? This question has not answered completely and often been debated. Law is something serious and the consequences can be fatal, moral could lead to hatred, boycott or prejudice from the society, if and only it has been breached. Law and morality has always link with each other. In the Hart-Devlin dispute, Hart argues that it is unnecessary to use laws to enforce morals because society was capable of containing many moral standpoints. Hart stated also that it is unacceptable to punish offender that do not cause harm to others and undesirable because it would prevent morality from changing. While Devlin argues that certain activities should be suppressed simply because it is immoral. He expressed his views as “ the suppression of vice is as mich the law’s business as the suppression of subversive activities.” Should law and morality overlap? Like for example, should a person being punish for not saving a drowning man? The man has not convicted any crimes that need to be imposed by legislative. He can do so but he lacks of moral value that they society will sees him as a cruel and immorality person. Even a person committed murder in the name of self-defense cannot runs from the law, still he needs to go to jail.
