TUI UNIVERSITY Module 2 Case Assignment ETH501 – Business Ethics Introduction The sole remaining supplier case presents a dilemma that can be examined using utilitarian ethics. The core issue is if the transistor company should sell transistors to the pacemaker company. To demonstrate that the ethical answer is yes, three tools will be used to analyze the issue. First, the question will be examined from Jeremy Bentham’s perspective. Second, the utility test will be applied to determine what action will result in the best outcome for all affected.
That would be perfect for the company but will still put people in society at risk, which is ethically wrong. The estimated cost for the A-1 Trailers recalling the trailers and fixing them will cost about $18,000,000. After reviewing the possible outcomes, the only why to achieve the greatest net benefit within society is for A-1 Trailers to perform a recall on the trailers. If A-1 Trailers fell it is in the company’s best interest to proceed with the 18,000,000-dollar recall and simply settle the claims after fighting them (if any), A-1 have every right to this decision. A-1 is in no way obligated to make any decision based on the so-called "greater good".
Malcolm Gladwell’s Theories Make Him an Outlier or Just a Liar? In 2008, Malcolm Gladwell explains the story of success in his national bestseller, Outlier. Through his psychological and sociological perspective he shares his theories on how past/current successors have achieved their goals. As a result, due to Malcolm’s inclusion of the non-fictional stories of current successors, this will impact readers all around the world that success can be achievable under his theories of opportunity, 10,000 hours, and cultural legacy. Gladwell tries to convey the reader that success is attainable through the three of his theories, opportunity, the 10,000-hour rule, and cultural legacy.
In order for the court to determine whether or not a trademark has been infringed, considerations such as the “strength of marks, the similarity in appearance of the products, the meaning of the marks, the kinds of goods in question,, and the intention of defendant using the mark” must be considered (2012). Since the news publications borrowed the trademarks to gather news, by way of polls, they were protected under the First Amendment. Though I do believe the news ads could have confused some consumers into thinking that the New Kids were the ones who set up the ads, I do not think it would have fooled most. I believe the defendants presented a strong case, and ultimately it was strong enough to beat out the case of the plaintiff’s, the New Kids on the Block. I argue that the original ruling in favor of the defendant was fair and just.
The classical approach includes scientific, administrative, and bureaucratic management.” According to the course reading scientific management focuses on the best way to the job. Administrative management focus is the manager & basic managerial function. Bureaucractic management focus is on the guidelines structuring with formalization of rules, procedures and a clear division of labor” (Bateman &Snell, 2010). The second approach is the behavioral approach it stresses the understanding and significance of the employee needs and their attitude towards the organization. You can see this function in action the way the employee works as a team, the way they communicate openly, and the way the job is designed by managers.
Since he was not the one who actually stole the car and it was not his idea, I would use the opportunity to guide him in the process of making better choices. First it would be imperative that he admits the remorse and then I would want to work on the responsible decision making. Critical – Evaluative Level 1. Rules, professional codes consulted, state laws, etc. - After referring to the ACA Code of Ethics (ACA, 2005) I found that under section B.
Finally, there is a dangerous lack of oversight by FDA regulators into the safety violations of companies such as Chemins leading to a reduced rate of public health and safety. Display: There are a number of options available to the Chemins company to deal with the ethical issue of mislabeled products. One is for the company to submit to mandatory testing of their products in order to ensure that what is on the label is what the product actually contains. This testing can be performed at the expense of either the company or the government, though this author believes it is the job of a company to own the regulatory compliance expense of ensuring its products are safe for

In the case of Wexler vs Greenberg, we found that the owner of a trade secret is protected against the use of the information by others when it is wrongfully obtained by impermissible means (like theft). In this case, it appears that with the precautions taken by Toshiba (by limiting the production of flash memory devices to one factory in an attempt to protect the technology from leakage) information was definitely given to SK Hynix under unethical circumstances. The articles in The Japan News only stated that Sugita had been an engineer at Sandisk, not that he was the developer of the technology. In this argument, it certainly appears that Toshiba’s rights of ownership of the NAND research data were violated. The second argument of trade secret protection revolves around fair competition.
