Introduction to New Form of I.E.M Conditions of Contract for Civil Engineering Works 2011

Abstract

A Second Edition of I.E.M. Condition of Contract named “I.E.M. Conditions of Contract for Civil Engineering Works 2011” (hereinafter IEM. CE2011) has been introduced through seminar which was held on 10th March 2012 facilitated by Ir. Oon Chee Kheng, who has been commissioned by Institutional of Engineering Malaysia (hereinafter I.E.M.) to produce the said edition of Conditions of Contract for Civil Engineering Works.
The New Edition for the I.E.M. Forms of Contract shall consist of 6 forms of Contract , namely
a). I.E.M. Conditions of Contract for Civil Engineering Works;
b).I.E.M. Conditions of Contract for Mechanical and Electrical Engineering Works;
c). I.E.M. Conditions of Contract for Nominated Subcontracts;
d). I.E.M. Conditions of Contract for Design and Construct,
e). I.E.M. Conditions of Contract for Minor Works and;
f). I.E.M. Conditions of Contract for Domestic Subcontracts.
The others forms shall be published subsequently within year of 2012. These forms of Contract basically are drafted in such way that it is in simple form of English, which are easy understanding by the Engineers who are not familiar with “Law Language”. These forms of Contract are purely drafted by Sub-Committee of Engineering Contract of I.E.M. which is Standing Committee on Professional Practice of Engineers, to replace the previous version of conditions of contract, which are hybrid Contract of PWD 203 (1987) and F.I.D.I.C.

Philosophy

The IEM. CE2011 was drafted in such way that to follow the general guidelines as below:
• The provisions are contractually equitable with the balanced allocation of contractual risks and benefits
• The provisions are simple, practical and straightforward to be implied and interpreted
• The provisions are written in simple English Language and clearly defined, easy understanding for non-Lawyers.
