HEALTH AND SAFETY INTRODUCTION This subject is about the responsibility of each individual to identify health and safety risks in environment. It is about promoting health and safety at work- for myself and those I am working with. The primary responsibility for its enforcement falls on the Health and Safety Executive which is part of the Department for the Environment. THE PURPOSE OF THE HEALTH AND SAFETY AT WORK ACT The Health and Safety at Work Act was passed in 1947 and was designed to help people to implement Health and Safety at work. It provides the framework for all law, regulation and code of practice in use. Legal framework The main act relating to health and safety at work is the Health and Safety at Work etc Act 1947 (HSW Act). This lays out general duties of employers, people in control of premises and employees. DUTIES OF EMPLOYERS TO EMPLOYEES Employers have a general duty under HSW Act to ensure, so far as is reasonable practicable, the health, safety and welfare of all their employees. Under the Act, employers have to * Protect the health and safety of their employees; * Protect the health and safety of others who might be affected by the way they go about their work (for example service users, volunteers, contractors and agency staff); and * Prepare a statement of safety policy DUTIES OF EMPLOYEES Under the Act, employees have to: * Take care of their own health and safety and that of others; and * Co-operate with their employer DUTIES OF EMPLOYERS TO PEOPLE WHO ARE NOT IN THEIR EMPLOYMENT Employers, care home owners and self employed people have responsibilities for the health and safety of people who do not work for them but may be affected by their work activities.
