Statement of Facts (chronological order) Elizabeth has contacted our firm to represent her and her daughter, Anne, in a claim against their neighbor Mary, for injuries Anne received while jumping on Mary’s trampoline. In researching Anne’s claim, many factors point towards supporting this claim. Still other information will be needed through discovery to support this claim. Anne has been a good student for several years. Anne is currently attending the 9th grade. Approximately, one year ago, Anne broke her leg while dismounting Mary’s trampoline. Anne is a good friend with Mary’s daughter and has jumped on this trampoline prior to this incident. Anne explained there were a total of seven occupants simultaneously playing on Mary’s trampoline on the day of her injury. Anne described how her left leg slipped through the springs, where she proceeded to fall back, pushing her right leg against the frame. The end result was a broken right femur. At the time of the accident, Mary was at a grocery store. Mary’s children and Anne’s sister were the first to tell the babysitter what happened. While inside the house, Mary’s babysitter was watching the children and was the one who called an ambulance and alerted Anne’s mother of the accident pertaining to Anne. After arriving at the hospital, Anne underwent surgery on her right leg because the break was severe. Anne stated that the pain in her leg “made her cry all the time”. Anne stayed out of school for two weeks after her surgery. The location of the trampoline is in Mary’s backyard and is accessible from Mary’s adjacent rental house. Mary claims she bought the used trampoline two years ago. Mary described the trampoline as in good working condition when she purchased this trampoline. However, Mary admitted that at the time of Anne’s accident almost all the padding covering the springs were torn,
