Criminal Law Criminal Law Danielle Cunningham CJA/354 August 17, 2015 Steven Duskie Criminal Law There are many cases heard at all levels of courts. The cases that typically get the most attention are those that involve the Supreme Court and issues that affect a large amount of people in society. Henderson v. United States, 575 U. S. ___ (2015), is about firearms being given to third parties after they have been convicted of a felony. Tony Henderson v. United States, 575 U. S. ___ (2015) In April 2008, United States Border Patrol agent Tony Henderson committed a felony by distributing marijuana. He distributed marijuana while in his government vehicle and while wearing his work uniform. Henderson plead guilty and was sentenced to “six months in prison and four months’ house arrest” (Pinkham, 2008, para. 1). Felons are not allowed to own weapons, so Henderson had to surrender nineteen firearms to the Federal Bureau of Investigation (FBI). Upon his release, he requested that the FBI transfer ownership of his weapons to his wife or sell them to a third party (Alter, 2014). His request was denied because felons are not allowed to possess firearms and there was a fear that his wife or the friend who wanted to buy his firearms would give them back to Henderson. The request made by Henderson to transfer ownership of his firearms was denied by a federal judge and an appeals court, so he took his case to the Supreme Court. In Henderson v. United States, 575 U. S. ____ (2015), Henderson is fighting 18 U.S.C. § 922(g), which prohibits certain people from shipping, transporting, receiving, or possessing a firearm (Doran Brooks, 2014). Henderson wants the courts to release his firearms so that he can sell them. The Supreme Court decides in favor of Henderson.
