Hardison recommended accommodations that were rejected by Trans World Airlines, Inc. because it would create undue hardship for the company in the form of increased cost, decreased efficiency and imposition on other coworkers. Hardison was dismissed on grounds of insubordination for refusing to work during his assigned shift. The court decided that Trans World Airlines, Inc. successfully won their case because they made every effort to accommodate Hardison’s religious beliefs, did not deviate from a seniority system, and prevented undue

Please make sure that you familiarise yourself with all of the company policies that will assist you within your job role. It is not only important for the company to have full and up to date details of agreed ways of working, it is also a legal requirement. It is vital that this company can show up to date documents, in the forms of policies and procedures, so that employees can gain a better insight into how the company works with others to promote best practice. Little or no documentation relating to agreed ways of working, would breach national regulations, and the standards of this company.
The former employee, Pelvas, complained to the EEOC that the mandatory services are in conflict with his beliefs. One of the defenses that Townley used was the “undue hardship” if they accommodate religious beliefs of Pelvas, which would excuse him from attending the religious services. Townley lost in this argument because the court did not see undue hardship happening for the company if they not allow Pelvas to attend the services. For our situation, we can win in this case because our claim of undue hardship is valid, unlike the Townley’s. We needed this shift change because of business necessity.

For example, if a care home decided to organise a religious service for the home because the majority of residents are that religion, this would include people of that religion but anybody else would feel excluded. 1.3 Practises that support equality and inclusion Because everybody has different needs, employers need to be flexible so that everyone can have equal treatment and not be discriminated against. For example, if an employer offers flexible shifts, staff can fit their responsibilities such as child care around their work and not be excluded.
